Ron Gotcher said something similar... they may be trying not take any more
applications from 2000-2009 until they finish the backlog. That may be one of the
reasons why they may have retrogressed to 2000. Just my 2 cents.

My last post in the matter. By our perspective, what I meant was, if you see an article talking about common topics such American Compititiveness or Illegal immigration you can always send an e-mail to the reporter and talk about plight legal immigrants. In most cases you will see a response from the reporter, whether they publish it or not is generally a matter of who you represent and audicences to the cause and other issues . That's why I said if IV as an organisation sends an e-mail (it could be me or you but representing IV itself) there is a possiblity that you will be taken seriously. But repeating the same issue to the same reporter 100 times will not make it any important it might even have a deleterious effect. I have seen this method working in the past. If you disagree with my approach, let's agree to dissagree on our approaches.
--> Hear you totally sending one single message but what will you release for press and how often will you do it. If I am not mistaken, You are suggesting that we come up with a list of issues and do a press release and that should be fine. Well, Its a good idea and I am sure we had PR releases when there were events.
If you are saying that we should do a press release now instead of sending personalised emails, I guess its gotta be more with the $$ than being able to do it. Not all reporters, do leave an email and google might do the job. I have tried sending emails to such reporters and the response has been lukewarm over the past 2 months. Here is what one reporter has to say.
Well, youve got a hard sell now because everything is so centered on the elections, and the larger immigration story centers on the undocumented (who are far greater in number than high skilled immigrants, at least those seeking green cards.) A lot of media outlets also dont have immigration reporters per se. If I were you Id target business reporters. But make sure they havent already done something on this in the past year, because even though not everyone listens to or reads everything we do, we do tend to wait a while before repeating the same topic.
Mostly the problem is we all have tons and tons of possible stories and not enough time to do them all, so I can understand your frustation
Do you think that if 3 or 4 more of us has written to her, will she re consider it? may be or may not be. I dont think they have so much time to cause a detrimental effect. They dont want to write on it, it goes to /dev/null :)
<---
If this is the case no matter how many e-mail we send it will not have any impact on him/her. That debate is almost like Conservative vs. Liberal debate and no amount of convincing can convince the other side.
I thought that was what we are doing. 25, 10, 1000 are all numbers, if 1000 is a spam why 25 isn't a spam. I think it is subjective.
--> Well, There is too much prediction on this forum than sending emails to people. Forget about email, I doubt if every member has sent the webfax. When you call it SPAM, Is it 100% unsolicited, undesired and one of those email that should have gone to the bulk folder but came to Inbox? I dont think so. But by doing copy/paste, we might be just telling that we are seeking attention. By writing in our words, may be we are expressing a concern. Public can always write to media and lawmakers. Circling back with the number 25, I dont consider it a spam if 25 people express a genuine problem in their own words
<--
Anyway, I will contact a local reporter and see how it goes, but I will not send e-mail to this editor becasue there are already e-mails sent by others conveying the same thing.
-->I will be very happy if you can elicit a response easil y and will learn the tricks from you ;) Sure, You can refrain from sending an email to this editor as I clearly see that there have been ~ 10 or more emails.

Freakonomics and IV participation by EB3IFreakonomics
The guys from Freakonomics did an experiment in a Chicago school. They said they will give $50 to all students who will get a B or higher in all their subjects. After some time they have found out that students who were getting a grade in the vicinity of B earlier have improved their grades to B level. But the students who were already well below B, actually went down in the grading; from D to E for example. You can google for the details.
In the GC saga, what we need is a B grade or above.
EB3 Mexico already has a C grade, hence he tries hard to improve himself to a B grade.
EB3I is in D grade. We more or less feel that trying hard is a waste of our time. If we try hard, we might get a C grade (means EB2I folks will get GCs :( :( ). The end result is that we go from D to E. That is what you are really seeing.
PS: despite the above generalization, I am planning to participate in the advocacy days in DC and I have already contributed to the efforts. Because human beings defy logic and what is natural to other life forms on earth.
If we don't stand up for ourselves, no one will do it for us. Mexico continued its advance in today's bulletin but there are just too many people in the queue to get this solved the right way.
My esteemed colleagues from India and China, if I am worried enough to donate and register for the April event, WHY HAVENT YOU?
Register now or donate to help fund the event. This is our chance. Those $50 you will spend on dinner and a movie this weekend can help us solve this once and for all.

you know, they posted August 29 for I140 at Texas, i predict it will magically move back to, lets say, July 28.
Then it's a forward movement..move back is retrogress.

He called it garbage can out of bitterness and perhaps a little sarcasm. Obviously this is very important to him, otherwise he wouldn't have vented to perfect strangers on the internet. Have you never really wanted something and lashed out at it out of frustration?
Thanks Almond. At this point, I am hoping USCIS will at least allow me to change jobs (remember - I am on 7th year H1b - approved I-140, did not apply for I-485 due to retro). some members here said this is possible and some other members said I cannot do this. so I am confused if I can do this or not. If at all USCIS lets me do this, it would be great if I can find a new employer who can do EB-2. I am praying to God to help me while I try this route. I am not asking too much here... am I ?

Do you know how much more the premium would be for this product compared to regular term? I am guessing a lot more. In that case whole life is better where the cash value generated would pay much more after 30 years based on a low 5.5 - 6% estimated annual return. But of course it is for folks who will stay in US at least 15 years+ because after 15 yeras the Cash Value could itself pay for the permium and you do not have to pay any more premuims unless you wish to boost the Cash Value further.
Its not a lot more.. about $200 more per year.. ... but atleast you get back all your money..

Kavya Shivshankar won the spelling bee 2009
http://www.cnn.com/2009/US/05/28/national.spelling.bee/
I watched the entire fiinal. Apart from kavya my favorites were Kyle Mou and Tim ruiter. This was Kyle's last chance, but I hope Tim wins next year.
Just thinking aloud : Out of 11 finalist 8 were kids of immigrant parents (7 of them indian). is it just co-incidence ?
I hope after watching this, americans should now have no doubts that imiigrants are here not because they work for less but because they are good at what they do and they are hard working people.

This whole spelling bee thing is the stupidest thing I have ever heard of. By any standards, it is pure and simple torture to subject the kids to memorizing thousands of words and their stupid spellings. And what use is that? Have they never heard of something called SPELL-CHECK in Microsoft Word and other email services ?
Or are they afraid that their kid will go to a job interview and someone might ask them to spell the word that no one on the planet ever uses and is only present in the Oxford Dictionary.
Those who subject their kids to such a regimented, rigorous, scripted childhood are preparing a next generation of work-force that would only know how to follow the orders and accept directions.
85 % of the fortune 500 CEOs are not MBAs. And the other 15% that have an MBA, only 3 of the 15 have done MBA from an IVY LEAGUE school.
What that tells you is that too much education and scholarly childhood increases your job security, in that sense that you will never be unemployed, but it decreases the chances that you will be on the top or you will be a billionaire.
The biggest prize goes NOT TO people who can follow directions and know everything, but who can GIVE directions and get things done.
It's like saying if I owned only one company's stock then I could be the richest person in world. Why do people diversify among stocks and then bonds? The moment you diversify you lose your chance to become the richest person in world.
A higher education betters your risk assessment. Your statistics may be correct but what your numbers don't say is the opposite side of coin? What is the percentage of people who don't have high school degree and earn less than $100,000 at the age of 35? Now what is that percentage for MBAs? What is the percentage of people who don't have at least a bachelors degree and are better than Project Manager by age of 35? Now what is that percentage for those who have at least a bachelors? The reason Sachin Tendulkar cannot hit fastest century but can score many centuries is because he is properly trained. He can assess risk better than Shahid Afridi can. Even though Shahid Afridi once had fastest century he was nowhere close to Sachin. Finally, a look at GM and Ford history from 1920 to 1940reveals the reason behind a need for a better risk assessment.
I don't see why everyone should strive to be the richest person or C-person in the world. Everyone has different value system. Some may like 9 to 5 job because they can enjoy other things in life... like lying down on beach, watching your child take first few steps, etc. Some moments never return in one's life.
I work with different Managing Directors, they earn a decent $250+ salaries but none of them even want to become CEO or for that matter any C-titled manager. I know one MD, in early 50s, who passed the C job because he wanted to go fishing with his 4 sons at his vacation home in New England... At that time he told me, "Once these bastards leave me I guess I will cherish spending time with them fishing at my vacation home more than counting big dollars in my bank account".

Strange, this guy gets banned, but the person that opened a thread seeking advise on his "shop-lifting" immigration advice, does not. Wonder what our standards are with regards to banning people.
[Dont want to report posts any longer either as those seem to be falling on deaf ears..]
Shoplifting does not divide EB population. But if you open a thread to pitch EB3 against EB2 then I think he should be banned. I can click the red triangle on top of post to report it because I do not think anyone in IV or any senior member has time to waste all day reading every post and deleting them.

Even if its multiplied by 100 we should be ok, if the USCIS does a good of not waisting visas by doing their best in the month of Sep. Say we have 6500 * 2 .25 (Family) = 15000people waiting from EB2 2004. Looking at the spillover numbers from last year, we might be lucky enough. Just trying to be optimistic for the next 35 days.

Your lawyer seems to be incorrect on this. You may want to consider getting second opinion.
AC-21 can be invoked on H1 as well as on EAD. Your choice.
Many times, joining second employer is relatively easy on EAD as it involves no H1 filing (less paperwork), but using EAD requires one to travel ONLY on AP.
Using H1 is more peace of mind. If for some reason I-485 is denied, one can in US (and work too) until H1 status expiry date and handle appeal more effectively.
Hope it helps.
----------------------------------
Permanent Resident since May 2002
Thank you for this information.
I still have about 2.2yrs left on my 9th yr 3yr H1 extension. So if i don't need EAD when i use AC21 do i just file AC21 or do i need to transfer H1 too? And i guess this means even after i invoke AC21 i will still be on H1 status which is what i prefer.
Also is there any CIS links stating we don't need EAD to invoke AC21 so i can talk to my lawyer?

Probably your lawyer is correct that you cannot take advantage of family leave (maternity act) with less number of employees in the company than required for that.
From what I understand about H1-B, you CAN take leave without pay - no problem with that...as long as you are on your company payroll i.e. your employement is not terminated.
Does any of you know what rights for maternity leave has a pregnant H1B visa holder? I want to stay home next year for 3 months to take care of my baby, then start working again.
From what I know I can only have the 6 weeks of short term disability.
The Maternity Act does not apply in my case because the company I'm working for has under 50 employees.
I asked my lawyer if I can take any unpaid leave without loosing my H1B status and her answer was that I can change my visa to H4 or become a part time employee for a while. I do not like any of this options because I'm in my I140 stage with my green card and I do not want to lose it at this stage, after waiting for years to get my labor cert approval.
Your answer would be appreciated.
Thanks
