My gut feeling would be in agreeing with what your attorney says regarding the difficulty with the same job description but differing EB category.
However, I don't think the attorney would have filled for the EB2 knowing that it would not be accepted, especially if your company is paying for the process.
I guess you'll only really know if the tactic works when your EB2 LC is resolved.
I'm far from an attorney, but your general position seems similar to what I've been considering for a while (that's why I know a little bit about this). one more question... if I reenter using my AP then IO always take you to some place/room to verify something or its sometimes/randomly only? I just realize that my connection time while coming back from one airport(POE) to another is just 2 hours.
I can tell you right now that 2 hrs is not enough time for your connection flight and it is NOT RANDOM.its for all AP holders

At the end of his remarks before an Asian-American and Pacific Islander Summit in D.C., Reid said, �Finally, we will again pursue comprehensive immigration reform that respects both our nation�s laws and the people from all nations who want to live in America, work hard and pay their fair share of taxes. And it is critical that we bring families together by cutting down on the long waits for prospective immigrants trying to join their immediate family members in the United States. I am committed to reforming our system in a way that is tough, fair and practical.�
He was immediately faced with skepticism and outright hostility. Though the senator was vague on details, one website promptly posted the headline, �Why Does Reid Want to Ram Immigration Amnesty Through Senate?�

I trust IV core members 99% for their efforts. But the remaining 1% does not come from the fear that IV is corrupt financially. It comes from the lack of information. If IV does not let the members know about their plans, how many members do the core expect to trust them and make an almost blind contribution? I suggest that members who want to contribute do the following.
1. pick up your phone and get ready to contribute.
2. call IV and during the call, contribute.
3. verify with IV that you are not a spy by giving your detailed information.
4. IV email you or mail you the ongoing plan.

Hawaii is an outlying US state. Going to Hawaii should be no different than flying between two cities within continental US.
Please double check on the advice before traveling. I know from personal experience that when you travel to South Padre Island, which is very much a part of the US, on the way back you are stopped at a check point. If you are not a citizen, or a permanent resident, then you have to show your papers.

I dont know if this is possible but how about applying for EB3 using premium processing and once it is approved u have ur prority date set to Apr 2004 and then apply for EB2 I140 and ask for the April 2004 priority date.
I am not sure if u can do this, looking forward from others to see if this is possible.
It is possible as mnkaushik suggested. And your employers don't have to revoke the EB3 140 in order to file the EB2 140. You will need to file EB3 first and after it is approved, file EB2 and port the EB3 PD to the new application.

With the revision of the bulletin being revoked, things kind of worked out ok. However why has'nt anyone looked into what exactly happened on July 2nd and who was responsible for what? All the questions that Zoe Lofgren asked were very legitimate. Why were they not answered? We had Condi Rice say that all visa's were exhausted; this was on TV. Was she lying or mis-informed by someone in her department? Who misinformed her? What was the motivation for revising the bulletin? Who ordered the mass-processing of pending applicatons that we have now seen? Why were all dates made current in the first place? Which agency did it and who did they not talk to?
If it were not for the flower-campaign induced media exposure, and the tough stance taken by Zoe Lofgren, USCIS/DOS could have gotten away doing whatever they wanted. What if the next time something like this happens Zoe is not working on the immigration subcommittee in the House? No one else stood up against this mangling of the law. If you steal a car and two weeks later go put it back where you took it from, it does not change the fact that you stole the car and must be held responsible for it. Where is the responsibility for what happened on July 2nd?
Anyone contacted the Ombudsman to see if he is doing a special report on this July 2nd fiasco?

there is no isue while filing for I-485 also. when you file for AOS, F-1 status becomes invalid.But, you will get EAD and that will give you all the work authorization you need. You DO NOT have to change spouse back to H-4.

For sure it wont' happen. There is no practical way to implement it. So stop worrying about all these hypothetical issues.
