i am switching employers and i have about 10k in my 401k with current employer. my next employer does not have the option to start 401k until after one year of service.i am looking for options to rollover my 401k to a IRA in a company. does anyone have any recommendations?thanks in advance

I still have my 401K from my old job that I quit about 3 yrs back into the same (company's) account. The reason I didn't roll them into IRA is that I prob would have made the same selection of mutual funds that I currently have in my 401K. The company is stable so no worries there. Point is, move your money only if you think it will serve you a better purpose or else wait for your new 401K to kick in and after that just roll over the other account directly into the new one...

Just my 2 cents, of course...

Hi
We had applied for an extension of my in-laws visa, and it got rejected. Is there any way we can appeal this decision?
Also, they are here a day past their I-94 expiration. Will their multiple entry visas be cancelled? They will leave within 30 days time past their I-94 expiration.

I spoke to my lawyer today and she made it very clear that it is ILLEGAL to file more than one I-485 for one applicant (from 2 diff companies). USCIS will immediately ask you to make a choice.

My PD is 1st Aug 2006. Am i IN or OUT?

As per VB:

The cut-off date for an oversubscribed category is the priority date of the first applicant who could not be reached within the numerical limits. Only applicants who have a priority date earlier than the cut-off date may be allotted a number.

They stress and bolded "Earlier Than" so i am not IN???? :confused::confused::(:(

My h1 is valid till march 2010.. but the i-94 i have is expiring in Oct.. (i changed my job ..and had been out of US..on the old stamping..)

Can iget it extended staying in US? or do i have to leave get it restamped in desh.. ?

Is it illegal to stay on expired i-94..but witha valid H1?????????

You could have asked for the old I-140 priority date to be tranferred to the new I-140 at the time of filing the I-140. Now that the I-140 is already approved, it will be difficult to get them to make any changes on an approved I-140. Interfiling of new I-140 with old I-485 is possible once the visa number becomes available. The problem is that USCIS does not always acknowledge that they have done this, therefore you might be unsure if this was done or not. Some people prefer to file a new I-485 for this reason.

Thank you for your response. Company B is not willing to sponsor H1B.

Lets say if campany A keeps paying me (runs my payroll with salary specified on my H1 petition) Will that keep my H1b alive and active when i work on EAD for company B ? ( Did i get that right )

Will USCIS know that i have switched jobs in between ?

What does IMHO mean ?

The RFE was for biographic information of the passport (basically a photo identity matching the name). It appears that my lawyer may have missed sending separate copies of it for each application (485/765/131). Anyway I sent color copies of the passport pages as well as driver license. The status for the application changed to "Response to request for evidence received on 10/09/2007 and processing resumed".

As far as your FP notices, I have read that others have been able to get the notices after calling the Service Center customer service. You might want to consider that.

HI All,

My H1 will expire by the end of October and my employer has applied for LCA on First week of Sept and it got denied. (the status on iCert shows as Denied). My employer has sent the FEIN Info and waiting for info from DOL.

I am not sure how long we will wait for DOL to respond back on this .. Do we need to reapply for LCS as i need to apply for H1-extn before end of October..

Could Pls some one suggest the best course of action..

Mine is 3 years Indian BS and they need 4 years US BS.

As per NSC Indian BS ( We have up to TY means third year-3 years ) is not equivelent to US BS ( Four year for Bachelor )

How long will it take to get the receipt number when we apply for H-1 extension? And how long will it take to get the decision?

I am assuming when I have the receipt number, I can be considered to be in legal status and keep working with my present employer though I-94 is expired.

Please help with your answers/suggestions.

You got that right! Once a citizen you can choose to leave and enter whenever and stay outside the country for as long as you want.
