People in Eb3 visa are not our enemies most of these people are our friends. We all have friends in both categories suffering. The issue exploded because of the contents of letter drafted by pani_6. It was pitting eb2 vs eb3. We all agreed all along that entire immigration system needs to be changed but here we have a letter that says dont give visa's to eb2 because we are not getting any. That I feel is unfair because all these days these spill visa's were going to ROW and people like pani_6 were perfectly happy but once their friends from eb2 (Ind) started to get them he was crying fowl.
I think we all agreed that the letter contents were somewhat pre-baked. The letter campaign was a idea in the right direction.
And mind you, we are now very active not because EB2 is moving, but because we now have concrete proof that the system was changed this year. You are probably talking about a thin % of peoples - this is a lame argument for most of the Eb3 folks who can and want to port to Eb2 legally.
Let me give you my case. I was eligible for both EB2 and EB3 when my GC labor was filed - my employer filed it in EB3 because the queue is longer and i remain with them for longer duration. I had about 390 days of H clock left so arguing with that employer and finding another one was also not an option because for getting H extension beyond 6 yrs needs the GC labor to be more than 365 days old.
By the way I've seen the horrors of Labor Sub , I've suffered BEC cold storages for years,now I'm struggling with my Eb3 140 for 15 months at NSC and after all that if i port to EB2 and get my 485 quickly - what Problem you have or what's wrong in that ?
Good points, but let me put a counter argument. Two people , one is named SunnySurya and the other is named Mr XYZ. Both came to the USA at the same time in 1999. The difference was SunnySurya came here for his masters and the other guy came here through shady means.
Mr XYZ was able to file his green card in 2002 in EB3 category based on his shady arrangements with his employer, whereas Mr SunnySurya continued to do right and socially acceptable things i.e. studied, got a job and then after several years this big company filled his green card in EB2 category in 2006.
On the other hand after strugling for several years Mr. XYZ has collected enough years on his resume to be elligible for EB2. Now he want to port his PD

Let this be an example to all those who believe that trying to get Lou Dobbs to support any cause of Legal Immigration is smart, in fact it is actually foolish. He is simply against ALL IMMIGTATION completely, most of those comentators that attack illegal immigration are merely holding back their attack on ALL IMMIGRATION because that would be counterproductive to their cause with most fair minded americans.
Computer science graduates are in short supply in the US, this is a fact despite the outsourcing. Salaries for Computer science grads. are rising in the USA and the world over. Right now there is a deficit of about 100K graduates yearly in this area in the USA. The average Computer science grads can starts at a salary of over 60K whereas most college grads. in the US start at 40-50K annually. Computer science grads, also have easily better prospects to go on to higher salaries and better opportunities within 5 yrs.Yet Lou puts the programmers guild founder on his program to bash the H1b program................all while bashing outsourcing as the sin of sins.
Lets follow his argument for a minute, no outsourcing, no outsiders in the USA, few US students joining in Computer science, all with a 100K deficit of Computer science graduates annually. To his infantile brain of hillbilly economics that means higher salaries for native born american computer science graduates. Win Win for america right? No, more importantly it is catchy and does wonders for this ratings!

but until now 99% of us, are in the same thinking that as long as you have a valid stamping in the passport u r good for rentry..
so they dig and dig into our passports .. ? we ourselves get dizzy looking into all the pages of our passports.
Like UN said..wonder what we/they achieve with lawsuits,but we can expect a lot of digging into our cases during AOS...
(lawsuiting/challenging is no good idea with USCIS/DOS,they will not budge even a mm,they r huge monster govt organizations,it is best to move with the flow and instead work on ideas of allowing to file 485 when dates r not current etc..)

I don't think your view of Indian monopoly in IT is correct. It is a natural flow of human resources from countries which had plenty of it to USA which needed it.
The reason for Indians/Chinese taking up majority of H1B visas is that there are lot of educated candidates to pick from highly populous countries like India and China.
US never gave any preference to Indians or Chinese in H1B visas. The fact is India and China produced lot of graduates who were capable of doing IT work. If you look at it, IT job is not a hard thing to master for any Indian. So US had the necessity for skilled people, India and China had the supply of these people, naturally staffing companies came up to bank on this opportunity. It was a natural evolution, there is no bias towards Indians/Chinese. If you take any small country in the region, they didn't have enough qualified people so staffing companies didn't flourish in those countries.
This is one of those things that people are going to agree to disagree.
btw; my experience with the Chinese is that many of them came here initially on student visa and decided to stay. I don't know many that came directly here on h-1b. They haven't developed the network of staffing companies (main reason I believe is the english issue wheres people from India generally don't have this).

The content of the letter does not read like it was written by a college graduate - at least seek help with writing a professional letter, it sounds very archaic ! Bad expression, poor grammar, poor reasoning, unreadable.
The letter will fare better if it is at least readable.
I'm in EB2 but i will continue to help in IV efforts, and contribute $$ when i can for all efforts EB2 or EB3. I understand the pain of EB3 applicants, so do several (most) others.

Non-state actors are mentioned a lot here. Who are these non-state actors and who is responsible for acts of these non-state actors? If a few Pakistani citizens cross over and strike Indian cities at random and disappear back into Pakistan, what are India's options? Just to pray that in some 30-50 years into future all Pakistani terrorists will somehow realize their folly and turn into saints?
We are also missing the elephant in the room. India has 150 million muslims and we have our share of Hindu fundamentalists. These Hindu fundamentalist groups have been trying for a long time to equate terrorism to Islam (targeting Indian muslims) and Indian public at large rejected this notion so far (rightly so) and that may change in future and it may not be long before a Narendra Modi becomes Prime Minister. It will be a shame if a few terrorists destroyed that very tenet of India - "Unity in Diversity".

Anyways the fact of the matter is that we are in a limbo, all indications point to Obama becoming the next president of US. if CIR 2008 was any indication , we as EB applicants are royally screwed if Sen Durbin dictates his immigration policy. What is the use of talking about wars and innocent people when chances are that the advocate of his immigration policy is opposed to my main issue of EB reform. high low Taxes, 401k's, houses, Medicare etc will matter if you get to stay here in the first place. A average 6-9 years of paying taxes, supporting medicare and Social Security and we now need to think about moving to different countries where skilled immigrants are welcome....think about it. Just look at the CIR 2008 discussion to understand what i am talking about. Read the senators transcripts.
Ramayan was an epic written long time ago. It is a story(like stories in bibble). Creationism evolved just to oppose evolution theory and cause confusion to the evolution theory. They say it is based on science, when it is not. BTW evolution is also a fact, it is not just theory.

Draft of this letter itself is an invitation for the investigation into Labor certification process for the individual who are suggesting they were qualified as EB-2, but their attorneys or HR reps told them to file under EB-3.
Entire LC process is certified under the assumption that the employer in good faith has tried to hire US citizen and since he couldnt find a qualified US citizen for a that Job position, the employer is hiring an alien ( foreign national).
I am not supporting this petition, even though i am a victim of the backlog centres and my labor took 4+ years for approval.
We should all support IV's initiative for recapturing of wasted VISA numbers from the past years.
Fighting among indian EB-2 and EB-3 is useless and it defeats the purpose of IV unity.
IV seniours should immediately intervene in this matter and stop further discussions on this useless petition which doesnt have any legal standings and in itself is an invitation from DoL and USCIS to investigate the individuals who signed the petition and messed up their immigration process.

Someone gave me red in extremely bad language on my mother that I can not even copy and paste here. This is really bad. It you have guts come and talk to me. Don't write bad words on my back.
I am not concerned about red, the language was worse than uncultured.
I am really upset with the language. Admins can read the comment if they wish.

WASHINGTON, July 27 � Congressional Democrats reached tentative agreement Friday night on a major overhaul of lobbying rules that would for the first time require lawmakers to identify lobbyists who assemble multiple donations and turn them over to candidates.
The disclosure of what is known in political circles as bundling would be a central element of the first major changes made in lobbying rules in the aftermath of the Jack Abramoff scandal and other Congressional corruption cases tied to lobbying.
Democrats, who intend to push the changes through Congress next week, say the bundling disclosure requirement and a number of other changes would shed new light on the relationship between lawmakers and those who seek to sway them on legislation.
�This rewrites the rules as it relates to lobbyists and their influence on Washington,� said Representative Rahm Emanuel of Illinois, chairman of the Democratic Caucus and an advocate for the changes.
Democrats, who campaigned against what they called a �culture of corruption� in taking control of the House and Senate last year, are eager to finish the package next week as part of their drive to counter Republican accusations that Democrats are making little legislative headway.
Negotiators for the House and Senate Democratic leadership engaged in talks throughout the day Friday in an effort to reach final agreement on the long-delayed bill. They hit a last-minute snag over the level of bundled donations that would set off disclosure by the House and Senate campaign committees.
But officials familiar with the talks said that point appeared to be resolved in an evening phone call between Speaker Nancy Pelosi and Senator Harry Reid of Nevada, the majority leader, putting a deal in place.
�We have reached an agreement,� said Representative Chris Van Hollen of Maryland, chairman of the Democratic Congressional Campaign Committee.
There are other potential obstacles. The details had yet to be presented to the Democratic rank and file in the House and Senate. But officials said they were confident the tentative agreement would hold, and a spokesman for Ms. Pelosi said he expected the legislation to reach the House floor as early as Tuesday.
�We are committed to lobbying reform and we are committed to operating Congress in an open and transparent manner, and we will live up to our commitment,� said Brendan Daly of the speaker�s office.
Because of objections by one Republican senator, the House and Senate were not engaged in formal, bipartisan negotiations, and Republican leaders said Friday they were unaware of the details of the emerging agreement and could make no judgment. But Senator Mitch McConnell of Kentucky, the Republican leader, said repeatedly this week that Republicans were leaning toward support of the measure.
The tentative proposal puts new requirements on lobbyists as well as on lawmakers, and orders disclosure of contributions that have become alternative ways to curry favor with politicians by giving to entities like favored charities, special awards and honors and presidential library funds. Lobbyists would also have to disclose at least twice a year if they paid for meetings or retreats.
The measure would set a one-year ban on lobbying for former House members and senior staff members, and two years in the Senate. New restrictions would be put on lobbying by spouses, and lobbyists would be required to disclose any previous experience in the executive or legislative branches.
Politicians would be banned from trying to pressure firms and associations to hire certain lobbyists based on partisan background � the so-called Republican K-Street project. Lawmakers and top aides would have to recuse themselves from issues where there could be a conflict because of negotiations for future employment, and such negotiations would have to be disclosed within three business days. New public databases would be established of lobbyists� disclosures as well as of lawmaker travel and personal financial data. Penalties for violations would be increased.
Watchdog groups that have pressed for the changes were awaiting the details. �I am very hopeful about this legislation, but the final statutory language still has to be seen,� said Fred Wertheimer, president of Democracy 21.
Bundling became a focus after critics complained it was a back-door way for some lobbyists to ingratiate themselves with Congressional candidates by collecting a series of legal donations from others and then getting credit for delivering the cumulative amount and saving the politician the effort.
Under the tentative proposal, Congressional contenders and the respective campaign committees would be required to notify the Federal Election Commission once one individual had delivered more than $15,000 in contributions within six months or $30,000 in one year.
The plan initially approved by the House had put the responsibility for disclosing the bundling on the lobbyist. But in the talks, Senate Democrats proposed shifting the onus to the recipient and making the Federal Election Commission, which handles campaign fund-raising reports, the repository of the record.
But Mr. Van Hollen said House negotiators decided to consent to the change since the basic information being disclosed remained the same.

Bought a house, sold it. Changed jobs, moved cities, planning to buy a new house.
I dont think renting (flushing money down the landlords toilet) is a wise idea if you plan to live in this country for a long time.

Just putting LOL doesn't make it a joke..As I said India has bitten off flesh from Pakistan 4 TIMES!!! What do you have to show for your bite???
What does Pakistan has to show anyways? Foreign reserves? An educated population? Science & Technology? Rich people? Modernism? Industrial conglomerates? Military might?
All you have my simple minded poor fellow is madrasas, bearded mullas, slums and Jihadi terrorists with no balls. There is a Pakistani tank which stands in my city with its head bowed in shame and saluting the Indian populace. It was one of the many that were captured in the 71 war by only 4 Indian officers on just a Jeep..Now do you have any Indian tanks to show off at least? Forget tanks do you have underwear that you have captured from India? Now who is the joke on??
