Washington, D.C. -Tomorrow, Thursday, July 1st, President Obama will make what is being described by the New York Times as "a major speech on immigration" at American University in Washington, D.C. The President is expected to step forward to reassert the leadership of the Federal Government on the issue of immigration.
While a federal lawsuit against Arizona's SB1070 now seems imminent, the President must address the underlying issues that led to passage of the Arizona law. We hope the President will squarely address the public's frustration with a lack of workable solutions on immigration. He must place this frustration in context - lack of federal action leads to growing impetus in the states to pass laws, no matter what their cost, simply to try to resolve the impasse. The President should address this frustration, but should also address the undisputed polling that shows that Americans want comprehensive immigration reform. This can be his moment to bring people together by laying out a framework that will actually move Congress to complete workable legislation.
We also hope that the President avoids some of the typical election chatter on immigration, which tends to turn the issue into a political contest of who can talk the toughest. Rarely does the debate move beyond the issue of further fortifying our southern border. While border security is a necessary component of comprehensive immigration reform, we cannot stop there. Real reform must look past campaign politics and find solutions that will allow communities to live and work together without the anger and recriminations that have dominated this issue for years. We hope the President's speech will go beyond issues of border security and discuss with the same enthusiasm strategies to create a 21st century immigration system - a system which invests in ideas and programs that support family and community cohesion, promotes fairness and individual accountability, supports immigrant integration, and helps us attract the best and brightest from around the world.
"The crisis in Arizona was created by an absence of leadership and commitment by the Federal Government to fix our broken immigration system. My hope is that the President will use this speech as an opportunity to reassert federal authority over immigration law and policy, and lay out his vision for a path forward," said Benjamin Johnson, Executive Director of the American Immigration Council, who will attend the speech on Thursday. "Enforcement of our laws is important, but the President must rise above the angry and misguided political rhetoric that creates and then feeds a never-ending appetite for punishment. While a lawsuit by the Department of Justice is a necessary legal step, a lawsuit alone will not end the vacuum created by the lack of workable immigration laws and leadership to make that a reality. Over the last year, the President and his administration have expressed a willingness and desire to pursue a comprehensive reform strategy. Sadly, too few politicians have had the courage to stand with him on this important issue. The true measure of the President's commitment to this issue is whether he will create his own strategy for moving reform forward and whether he will expose those in both parties who refuse to step forward and create a workable, humane immigration policy that will strengthen America."
As the Department of Justice takes up the legal challenge, President Obama - through this speech and continuing actions - can place the responsibility for immigration reform back where it constitutionally belongs: in the hands of the Federal Government.

Please go and take some english writting classes first. Your english is very poor. Taking some classes will help you in longterm. MBA in US is taught in english not telgu. An MBA from a shady univ is not going to help you anyway and USCIS is cracking down hard on bogus porting these days.

I was under the same impression that it was FP that triggered the name check. But this is what the lawyer told them that their names were struck in NC and that is why they never got FP and now that NC is over they received FP notices. The interesting part is that within 3 weeks of FP one person got a notice that his application has been sent to USCISlocal office for further processing which I assume means interview notice in few days.
How does a lawyer know if u r stuck in namecheck? Unless you go to infopass you may not know.
In reality, the app was just taken up for processing - the IO figured that FP has not yet been done and sent notice and during the course of processing the app, decided to send it for interview.

Last year when I converted my out of state DL to a NYS DL, the DMV gave me a 5 year valid license (expiring on my DOB on 5th year i.e. in 2011) but on the fornt of the DL mentioned in BOLD RED the epriery of my I-797 date as 'TEMP VISITOR EXP.'.
So guess I am good till 2011 ...

If the USCIS cashes the checks and then returns the packets (total $1490 in my case), is there any legal recourse to get a refund from them? Since they are pretty much doing whatever they want, this thought just occurred to me.

I always loved this board for what it does - especially the Gurus who always spend their precious time giving input to member's queries. Well... this is not query. I just want to vent my frustration, helplessness to fellow friends in this board. In spite of graduating from a reputed univ with a Masters and very good GPA and also having 7 years of professional experience, I am bound to be a slave to my current Employer without any promotions, career growth or anything remote to that for next (God knows how many Decades) several years. ppl who are junior to me in every aspect are growing left and right and are also getting brighter opportunities. I dont care if you guys think I am jealous of them.... But does God really exist ? sorry for wasting your time with this depressing note. I guess there is a limit to how unlucky I can be !! call me a cry baby but I am one real unlucky individual !

Question gurus... I have a xerox copy of my approved I-140. Will this be enough to port the priority date? or do you need the original copy to be submitted along with the new I-140 application when you request portability of older priority date?? please clarify.

Oh, I trust the attorneys to file it correctly, I was just wondering if there was any way of finding out if it was received and processed correctly. With the H1B, 140, 485, etc. you get a receipt notice, but I wasn't sure if that was the case with the G28, probably not.
The thought of the remote possibility of any correspondence from the USCIS going to the old attorney (for whatever reason), and not making it to me/new attorney in time to respond to it, is a little unnerving.
Well, anyway, no point losing sleep over these things, although it is easier said than done.

My wife's H4 expires on Oct 1, 2007......We plan to file our I-485 by July 16, 2007.......I am sure it will take atleast 90 days to get her EAD.....whats her status between Oct1,2007 till the time EAD gets approved?......Will she be in valid status during that period?

For those of you who qualify, HSMP , I think is a much better option. There in UK the permanent residence is not dependent on employer and you can do your own consulting. Typical bill rates are 350 to 600 GBP per day based on skill level and years of experience.

And always send via USPS express mail. (1 day costed me $18) but I came to know instantly the next day that they received it.
You could also use some cheaper USPS option. as long as it has some delivery confirmation.
The reason I like express mail one day, is because u can request a copy of the receiver's signature via email (comes in a PDF). This is proof that USCIS really got it and u can then sleep nicely for the next 3 months.

I would not worry much about whether we receive our package back or not. Because If USCIS is "rejecting" then how would you/your lawyer know that it has "rejected" it unless it sends the crap back. So legally USCIS HAS to return /mail back to you otherwise it will face another lawsuite. The real question is How it will reject it? Would it open a package and check for insufficient/improper documents and put a note about it and then reject it OR just put a note of rejection on closed envelope and returned back without opening it? In second case we are absolutely fine as far as second time filing is concerned but guys in first scenario if you really send insufficient documents/improper documents then your case may be screwed permanently for second time filing. Actually people MUST ask about this to their lawyers before jumping into the bandwagon. I have asked and waiting for my lawyer's response.
