I efiled a month back both ead and AP, so far I still have "we have received response to your RFE message" Did any one get further to the next step after receiving this message?

A visa number gets allocated only when administrative approval is granted by NVC. Most likely when you applied (packet 3) last year your case was current and visa numbers was available, however by the time they approved your case the window was closed and PDs became U.
NVC does not order a visa number for cases pending only for cases that they have approved/completed.
They do this every month around the 10th like clock work, if by the 10th of any month your case is approved/completed by NVC & your PD is current they order a visa number for you from DOS.
We called the NVC 2 days ago about the status of our application and the guy on the phone (who was, BTW, very polite and patient) told me that everything was processed and as soon as our PD was current we would get an interview appointment very soon.
We also sent an email-inquiry to the NVC last week and just today we got the reply :
"Unfortunately, this case no longer has a visa number available. This is
because the applicant' visa category is oversubscribed, meaning that
the available numerical limit of visas able to be issued was reached.
Upon reaching the numerical limit of visas able to be issued, only
beneficiaries who have a priority date earlier than listed in the current
Visa Bulletin may be allotted a visa number in this visa category. "
So, that must mean that they had a visa number for us back in August 2007 when they sent us the DS230-I and the bills for the visa fees although according to the VB for August/September 2007 EB3 ROW was "U" ?
Hmm, I have to admit that I have kind of given up on understanding how this all works. I'm just looking forward to that day when we finally receive our GC and are able to move to the States.

This bill might do something good for some EB3 folks who have advanced degree but then again instead of a EB2 and EB3 difference we will now have an EB3 MS and EB3 Non MS difference and as i see it there is not much difference between those two. Same wine new bottle.
what about highschool dropouts vs college dropouts? literates vs illiterates? same wine new bottle too? then why the distinction of EB1, EB2 or EB3 either? Just hand them visas as soon as they get down that plane :)

Reading from this thread and few other, it is confirmed that in most cases, even if PD is current for a 485 filer, USCIS may not adjudicate those cases unless the processing time is reached. (There are few lucky applicants with PD 2005 and filed 485 after July 2nd and have already received their GC - but that is very few).
And most centers, they are processing Dec 2006 485 applications - a backlog of 10 months.
So, assuming that it may take same 10 months to process 485 filed in July - that is May 2008!!
With this, what are the chances of DOS making PD current for all EB categories again next June? They will do this to use all the VISA numbers for FY2008.
Or, if they don't want to repeat the confusions that happened in July 2007, to what dates will the PDs move (in June/July 2008)? Atleast to 2006?

I look at this bill in a different perspective:
1. This will give the Indian IT companies an opportunity to move up the value chain. Rather than body shop its employees to clients...they can have all the IT work done at its development locations. Also they can fill americans for half of its US workforce.
2. It will put an end to 100% H1b bodyshoppers who just make money without having any office and putting their employees onto client locations. These scrupulous bodyshops even dont pay on bench.

It is the RD of the 485 application that dictates the order of processing the application. In addition, for the application to the processed the PD must be current. Once the PD is current, it is the RD that matters.

1) Fast-track GC process for Masters degree holders from US universities. This will be the least controversial, boost admissions (and money) flowing into universities, and clear up backlog in regular GC queue. Its a win-win and most senators, congressmen have voiced support for it already. We can get very good support from University lobbyists also (if they exist!!).

One suggestion I have, which is followed by lot of websites with PHP Bulletin boards with high traffic is to use a separate server for boards pointing to something like forums.immigrationvoice.org and keep the main site www.immigrationvoice.org on a separate not so powerful server.
Atleast it ensures that the main site doesn't go down, when forum usage is very high.

You have rasied very valid point and Canada credit 50% of the time before getting PR there. But I don't think this is so easy to get due to chain migration fear.

in my case, the companies i worked at has spent nearly 50,000$ ( in USCIS + lawyer + misc fee) for my H1s and my GC applications.
I know there are plenty of suggestions flying around and here is my 2 cent, it may or may not make too much sense, but here it is.
We can rant about the difficulties of not getting a GC, make emotional pleas of our struggles all day, but nothing talks better than money. In the current scenario nothing will grab more attention if you can show how we contribute to the US govt and the US economy in monetary terms. Nothing else will get the attention of these lawmakers like money can. ;-)
Can we put out some numbers for the lawmakers, in terms of our contribution to federal & state taxes, social security, property taxes and overall economy by way of our purchasing power home, cars, appliances, vacations, etc (all the amount that you spend in the US) and multiply these numbers by the number of folks waiting to get GC or who have the GCs. I am sure when you add all this up it will be a significant number, which is bound to catch some attention. Assuming the majority of us make more than the average American, all these figures will definitely standout.
Also propose a one time fee of $10,000 to apply for GC right away. I am willing to pay this fee if USCIS can grant me a GC or provide us a way to stay and work legally in this country with no tie in to the employer. This could be a significant amount of revenue, especially when all lawmakers are looking to reduce the deficit and raise some income. As it is they are regularly increasing the visa fees to pay for some bill to the other like the 9/11 workers healthcare bill, etc. If a 100,000 folks(not sure how many are there in total) like us cough up $10,000 that could equal 1 billion. May seem small amount compare to the US deficit, but when you add up our total contribution it is significant. This may be totally outlandish, but I think something on this line is worth talking about. Like I said, nothing talks better than money.
Not sure if there have been other similar ideas, but if we can compile a few pages of such information with numbers, graphs, comparative charts etc and hand them out to the lawmakers it may help.
Comments and feedback welcome. May be this is totally a dumb idea, but if the admins think it makes sense willing to discuss and prepare something. Also this post is not meant to begin a debate or to distract us from our goal but just some thoughts.
PS: Have contributed in the past and intend to participate (financially and in person) on the Advocacy day.

After 5 months they're auditing my PERM application. My attorney just sent me an email. They're not asking for specifics but wants to make sure we advertised the position. Attorney's going to submit a report as to why the applicants weren't hired as well.

be cooling down 65% of peoples and thereby breaking down the concerted effort and lawsuit everything ....
Then once the steam goes off this issue send this 65% to some infinite coldstorage/blackbox like BPC... May be this time the BPC will be created in deserts of Arizona or Mountains of Colorado.
They are planning "Damage Control" for sure ...

HLG normally refrains from commenting on rumors, but we have talked to several Washington insiders and believe that this is seriously being considered.
What does this mean for foreign nationals who planned on filing I-485s in July 2007?
HLG recommends that all foreign nationals who planned on filing I-485s in June take two actions:
Have your medical appointments completed. Medical appointments can back up quite quickly. Therefore we urge people to complete their medicals.
Send in your documents to HLG. HLG�s I-485 Step By Step Guide has a list of documents that we need for all I-485 filing. HLG will not begin preparing the I-485 at this time, but we still recommend that you send us all of the items on the list.
