EB was current from AUGUST 1999 until April 2000.
This warning was issued in the March 2000 VB:
VISA AVAILABILITY FOR APRIL(2000)
�Demand for immigrant visa numbers by INS for AOS cases in all categories, continues to be steady but has not reached the level requiring action at this time. It is anticipated that INS demand for numbers will require the establishment of visa cut-off dates for April in some or all of the CHINA-mainland born and INDIA Employment categories�.
In May 2000. EB2 was retrogressed to 01JUL97 for China and 01APR99 for India
In December 2000 VB the big announcement came:
Greater availability of EB immigrant visas: On October 17th, the President signed P.L. 106-313. Title I of this law is known as the "American Competitiveness in the Twenty-first Century Act of 2000" and contains amendments to the INA regarding EB immigrant visas.
In fiscal years 1999 and 2000, due in part to the per-country limits, the annual limit for EB immigrant visas was not reached. P.L. 106-313 makes the following changes in an attempt to rectify the situation with regard to per-country limits:
Section 106 recaptures those EB visa numbers that were available but not used in fiscal years 1999 and 2000, creating a "pool" of approximately 130,000 numbers. These numbers could be made available to applicants in the EB1, EB2 and EB3 preference categories beginning in fiscal year 2001.
Section 104 removes the per-country limit in instances where the overall applicant demand for EB visas is less than the numbers available without regard to those limits. This determination will be made quarterly, based on a comparison of the overall demand versus the available numbers. If the total number of available EB visas is greater than the number of qualified applicants who may otherwise be issued such visas (during the same period), the per-country limitations on EB visas will be lifted for the remainder of that quarter.
In May 2001 EB2 became current again for both India and China.

All categories have become "Current" for July, and are expected to remain so for the remainder of FY-2001. The cut-off date movement in all oversubscribed categories has been extremely rapid during the past year. This is because the FY-2001 limit is approximately 50,000 higher than normal, and legislative changes removed the per-country limitation if there are otherwise unused EB numbers available.
All categories are expected to remain "Current" for the foreseeable future.

Recent discussions with CIS have made it clear that their backlog reduction efforts will sustain or increase the current level of demand. Therefore, continued visa availability in the EB categories cannot be guaranteed during the final quarter of FY-2005. If demand continues at the current rate, it will be necessary to oversubscribe many or all of the EB categories on a Worldwide basis. Such oversubscription could result in the establishment of cut-off dates, retrogression of already established dates, or some categories becoming �unavailable�.

In addition, it is anticipated that heavy demand will require the establishment of a EB3 cut-off date on a Worldwide basis by December.
The amount of Employment demand for applicants from China and India is also likely to result in the oversubcription of the EB1 and B2 categories for those chargeability areas. The establishment of such cut-off dates is expected to occur no later than December.
The level of demand in the Employment categories is expected to be far in excess of the annual limits, and once established, cut-off date movements are likely to be slow.
October 2005 VB:

Item D in the September VB announcing the September cut-off dates provided information regarding the prospects of visa availability during the early months of FY-2006. Many categories have become oversubscribed for October, and cut-off dates established due to continued heavy demand for numbers by CIS for adjustment of status cases. Forward movement of the cut-off dates in these categories is likely to be limited.
And IV was born.

Thanks for all your hard work with Ron and keeping this forum alive. I apologies for not being actively involved in the past couple weeks, I was not feeling well and whenever I felt better I had to work - to keep my job :)

It was a pleasure meeting and talking to you NeedHelp (dont want to use your real name here)..you are the sweetest ,warm kind hearted soul..The highlight for me was putting a face to all the names I had been in touch with on a daily basis..and ofcourse meeting my hero ..Aman ..
I missed all the fun , I was running between work and kids..but still will cherish the memories from this grand event..
Thanks to dh who let me do this and took care of the kids so well...they enjoyed the experience.
If I have to think of a funny experience , well not so funny I had my first red bull on the rally day thinking it will give me wings ...:D not fun..
After my meeting with the Representative's aide I asked him the directions to exit the building ,he asked me where do you want t go , I said I just want to get out and he and the staff laughed said thats what we feel on most days too..:)
Keep the Aroras seperate , that is, Puneet Arora and Sumita Arora....these guys would not miss a single chance to beat each other up.
Here is a scene I was in:
Paskal(Puneet) is driving - Sumita is sitting on the passenger seat - we have no idea where we are going. It is 2:00a.m and we are REALLY hungry and tired...
Sumita "I will give you directions from my Tom - Tom " I think she meant GPS.
Puneet (after taking several wrong turns) "It is not a Tom - Tom"?
Sumita- " whateverer it is , it gives me directions and I talk to it" (She was spending 4 hrs. driving each day with this TomTom ).
Puneet - "ok, let's follow our friends".
Sumita dials.
Vandana(in the other car) - "Yeah you can follow us".
Puneet - "well where are you guys"
Vandana - "We are trying to figure out, I don't know how we got here - Let me consult my GPS"
This is what happens when you are sleep deprived, food deprived - all the gadgets in the world cannot help you.
Jane( a chinese) - "why do you guys have to eat anyway, it is time to sleep???"

I'm in the similar situation as indian111.
I filed for my wife's EAD in the late May (e-file TSC).
Receipt date is May 29th.
Soft LUD on June 6th
FP done on June 21st
no updates, no changes after that. there is no LUD after FP. It's been 66 days since filed. Does any one know if I can take Infopass appointement before I complete 90 days of pending status and see what's going on? Or do I have to wait until 90 days are complete? any experiences?

2. But for the other applicants who are struck in BEC from 2003/2004, we are with you and we will work with IV to address EB related GC issues. I know BEC set Sept 30, 2007 as final date to process pending labor applications and many cases are approved.
So wait and fight for few more months and then file I-140/485 concurrently. IV will keep these people in their mind and will work hard during CIR or strive bill discussion so that no restrictions are put on your application while filing I-140/485. our prayers are with you.

Same here, Iam Dec 2005 and still waiting ..........
I have been looking at number and the IV forum and there are very handful number of cases with December 2005 that have been touched.
I think we need to cheer up and be optimistic in addition to creating SR, senator route and infopass. I have a feeling that all the October, Nov and December cases might be in a single lump of files and we will get it in the next week or so.

I work for a big computer company and my company policy is that i work from home (else i will loose some company benefits if i work from company's office).
I have a copy of my Labor Cert forwarded to me by Dallas Backlog center. Here is what i see :
On ETA-750 Part A: Item 7: "Address where Alien will work" = Illinois
On ETA-750 Part B: Item 7: "Address in US where Alien will reside" = Virginia
Given the above facts, and given GC is for a future job, What are your thoughts on my questions below?
1. Do i have to go back to IL or VA before I-485 petition ?
2. OR, Can i work from anywhere, like i do today, as my company has home based/iWork policy and apply for I-485?
3. After i go back to IL where my Labor was approved and after 180 days, can i invoke AC21 to move back to CA/other states for SAME employer?

Alright guys, I cannot tell you how excited I am to report that i got a call this morning from my attorney and my online case status also states that Card Production was ordered for my case!!!
After 8 long years.....i finally have been approved for permanent residency. After 7 years, i will finally, with peace of mind, go back to India to visit my family. Thanks to IV, everyone's help on these forums for helping me keep my sanity over the past 2 years....
After 15 years in the US, I will finally have my green card in hand soon.

I think spillover method has not been changed since years. The only puzzle is that whether it is horizontal or vertical or combination of both that USCIS works with we exactly do not know.
Do you guys agree ?

Guys let it be selfishness... but ultimately if we win, it is a win for every one... I am living in this country for more than 11 years but still with an EAD status.... We are spending most of our life time as an ALIEN. Think yourself which is better...
Saralayar, I agree to your point. As a note, you have to understand I have been in this country for about 13 years and working in the same job since 1999. I am still waiting for my green card as you can see from my priority date.
I don't mind members enthusiastically starting a campaign. I am all for it. I am sure IV core is also in support of it. But we also need to identify people who really believe in the cause and will continue with the cause irrespective of what happens to their situation. In this case, GCPerm has shown that the cause what he/she fights for depends on which basket he/she wants to pick his fruits from. When he/she gets his/her share of fruits they will leave.
I hope we do not waste our time and resources with people who are bound to leave when their situation is clear. That is my point.

My wife's status changed from H4 TO H1. Recently when she went to apply for her SSN, the officer there took her original approved H1 along with I-94 and never returned it to her. She assumed that they would need the originals . I didn't know about this since I live about 200 mi away from her.
We will contact them on Monday but in the worst case scenario, if they have lost it. Do I need to apply for a new I-94 or a copy will suffice.
Any hope??

I am in the same boat. I see 4 or 5 people postings of this messages.
None one else this forum in this situation. Why not we gather how many of us are affected? Then it will be easier for us to plan and request our case to be included on IV agenda.
