    I did see the two address entries in the form....however, i've almost lost all ties to india to even be able to present an address for correspondance. I've put both the address as my current US address.

    Where did you lookup the information on having an indian address on the form.

    Call 1-800-375-5283, follow the prompt to talk to someone (select the option 'your case is outside the processing time') and tell the person that you want to open a service request (SR) for your case. You should have your receipt in front of you when you call.

    Short answer is "NO".Assuming direct filing in consular Process, in general it takes less time (for most clear cases around 6 months to 9 months) with comparison to AOS. But that pattern was of old times. Consular processing also has to follow Visa Bulletin. Second factor also need to be considered is what ratio is for consular processing. If 10 % of total EB3 + 2 cases might have gone to consular processing then again those US visa offcies will also be overwhelmed. Seeing July-August load ,this time it is very hard to predict consular processing. But just sake for the argument if my prediction for future visa bulletin will become correct then MOST EB3 - 2003/4-consular processing filers will definately get their GC before December 2008. That surely can not be predicted for AOS seeing namecheck etc.

    Note: After some time (2008 end) you will also see fence jumpers (AOS to
    consular)as people will hear fast "initial" approvals from consular
    processing.

    Thanks for your prompt reply! I think CP filers would be around 5%. Atleast in my organization, in July, 70 people filed 485 and I am the only CP applicant!

    It seems like the major disagreement is on the issue of "granting amnesty" or that sort of act to illegal immigrants. Not sure if this is going to make a difference but approaching congress members with the concerns of legal skilled immigrants might make some difference. So if there happens to be a discussion and in which case more than likely the house will focus on the provisions included in the house version of the immigration bill which primarily focuses on border security etc. may still pass. If that happens there is a slight chance that they may agree on some if not all of the provisions for the legal skilled worker. We can do web fax thing or contact over phone etc....doesn't hurt to try......

    Called all the numbers. A couple of them were polite and said they will pass on the message and a couple of others said I do not belong to the representative's district. I ended up leaving voice messages on rest of the numbers.

    This thread is interesting to read through and it is always good to have a devils advocate.
    However, one thing for sure that saying mistakes are on us in a black and white manner is not justified.

    Whatever we decide we should have good communication among all backlogged applicants and follow the established process.

    I quoted a fact (rational and valid) to argue your assumptions. I never even claimed to know what USCIS would do and how they would present the data. It was you who presented a theory to justify that we should not go with any change in the spill over. I want to know why you dont want EB3I not to proceed with this measure. Is it because you believe it will take away numbers from EB2 or EB3I is doomed with plenty of cases and any amount will not make any changes. I believe its perhaps the earlier than the later. See, we all have our needs and we all want to look for ourselves first (including you and me). Its basic human nature. We all can generate obfuscatory facts to push our agenda. But at the end does it justify the means ?

    I just presented a theory. Right or wrong is upto you to decide. I never said EB3 should not do anything for or against spillover. All I am saying is spill over either helps Eb3 from 2001 - 2003 (perhaps some 2004) or helps Eb2 post 2005 now for all other Eb3 folks the hope lies in PD recapture or upgrading to EB2 ( if spill over rules benefit EB2 only).

    What about all those visa subs in July 07 with PD in 2002 - 2004 who are waiting less than EB2 2005 cases? Is it legal for them to get GC quicker the answer is YES. Is it ethical? I would leave it to the readers to decide.

    For new members:

    There might be differing views on how to reach all the affected green card applicants, but no one is disputing the fact that the current delays in the employment based green card system are unacceptable and we need to do something drastic to change it. If you applied in EB3 with a priority date in 2011, you could be looking at over 10 -12 years(?) to get a green card. The delays that could happen at H-1B visa stampings at consulates, including TAL checks and additional administrative processing are a huge headache for many.

    Currently, many green card applicants don't seem to know just how bad the situation is. The other day, I met someone who has been in this country for over 10 years, who thought that if you have a Master's degree, you can apply in EB1 and you will get your green card in a year!! True story. The reality is that even if you apply in EB2, you could be looking at 5-6 years and this situation can easily get worse.

    The Advocacy Days in Washington D.C. on April 4th and 5th are really important because "2011 is a crucial year to get the fix needed to clear the backlogs and allow for our high skilled immigrants to get the relief needed. We need to capitalize on the opportunity to push for legislation now, as it is unlikely to have any favorable immigration bill to be brought for the next 2-3 years (Primary campaigns, Presidential campaigns will take priority)."

    Participating in the Advocacy Days in D.C. is the best thing you can do. If you are within driving distance, this should be even more convenient.

    The following are some of the items on the Agenda (someone correct me if anything is missing/incorrect):
    -Re-capture of unused visa numbers
    -Removing country specific limits
    -Not counting dependants in the visa number count
    -STEM exemption
    -Allowing people to file I-485 and get EAD even when their priority date is not current.

We have only raised $23,050 and still need to raise $26,950, despite some members contributing hundreds of dollars each. We still need everyone's help to reach our target. There is only one week to go. Reduced funding will mean IV having to scale back Advocacy plans, and since this is our best shot in the next 2 years, we could be losing out on a lot.

    What is the current processing time for Labor? I heard it is taking very long like 8 to 10 months? Is this true or is this based on processing center? If so which processing center takes how long?

    1. Currently there is only one processing center - Atlanta...
    2. DOL (OFLC) does not publish labor processing dates...

    We need about 1000 members signing up for the monthly contributions in a month. I am sure we can do that. We have 8000 members and it should be easy. Till now we have only 100 signups

    Okay here we go. Here is a goal of having 1000 members on $20 monthly recurring contributions. 1000-100 = Need 900 members. Come on guys. Lets start deducting from this number. if you sign up for minimum $20 recurring, please post and say you did. Then deduct from 1900

    I mailed my passport for renewal to CGI Houston a week before it expired and it came back with a new passport in 2 weeks. I was able to talk to two people. Its very hard to get them on the phone....but yet I kept trying.

    The address on the form is kind of confusing. They do not tell in the on-line application that they are expecting an Indian address and a US address unless you print it and see for yourself.

    That link has the complete text. Relatively simple text. Includes those who have completed degree in last 5 years or those who have resided in the US since obtaining a degree.
    Only one constrain. Requires that "will substantially benefit prospectively the national economy of the United States". The second part is something which is fuzzy and not sure how USCIS will interpret it. They might apply the logic of EB2-NIW. However, in either case, it is adding numbers of EB categories and hopefully rest of the bill is allowing for these numbers to fall across and down.
