All those who are still waiting in BEC black hole, I feel for you. I was stuck in BEC for four years. Only managed to get out a couple of months ago after they allowed TR cases to be converted to RIR.
I tend to think the same way as chanduv23. Our final goal is a Green card, and it may still turn out that the people who are currently still waiting in BEC may end up getting their GC in hand before many of the ones that can apply for 485 in July.
The reason is that USCIS has clearly stated that it will retrogress big time in September. So, people with recent PDs may get to file their 485 but may have to wait for a long time for their PD to become current again to get the approval notice (folks, I am not wishing ill against any group here! I wish we all got our GCs ASAP. But since that is not going to happen, just trying to analyze facts). On the other hand, if BEC comes through with their sep 07 prediction, then these people with much older PDs may be able to apply for their 140/485 at that time and may end up getting their GC 6-12 months later because their PDs will still be current at the time of approval (Of course, this is assuming that they will not get caught in the Name Check Black hole)
So, all those who are still stuck in BEC, please hang in there, your day of freedom will arrive (maybe sooner than you are currently thinking).

In my humble opinion, it would be damaging to IV's goals to participate or otherwise support a lawsuit that would anger the very people that they are lobbying.
I'm not saying that the idea is not without merit, it just wouldn't be appropriate for IV to participate.

Going by that, I guess, dates may move forward very slowly until these new applications are dust-shed and taken for process. And, this may take atleast 6-9 months or more in my opinion (going by the processing times of various USCIS centers).
They have started FY 2008 with some caution after July fiasco and may ease it up a bit in the next couple of months. I am confident most 2002 cases and some 2003 cases would see approval in the next 3-4 months.
2003 EB3 India? That would be interesting (because dates need to jump forward two years for that to happen)

But are you saying that both of my above strategies are valid? I remember reading somewhere that one cannot be in I-485 on two applications. Please clarify.

Thank you very much mdforgc for your detailed response. I appreciate you taking the time to explain me. I have contributed $200 towards IV and am very pleased with the work of the IV core group. I hope we will continue the momentum we have generated and find a solution to our GC problems.
The first step you should get your employer to do is to file a job order in the state job bank or americas job bank. You have to keep this ad for 30 days and then wait another 30 days to file PERM. This is the longest time. All other forms of recruitment needs to wait only 30 days and you can file PERM on the 31st day. There is no mention of working days or weekends, it is 30 continuous days. As you know in addition to this job bank order, and two Sunday newspaper ads, there has to be three other forms of recruitment before you can file PERM. If your employer and lawyer are really proactive it will only take 60 days to file PERM from start to finish. You also have to get a prevailing wage determination and post it at your job site for 10 days not including holidays and weekends. Hope this helps. Please contribute and incrase the membership of IV for the good of all of us.

Hi
I mailed my passport renewal application to CGI houston on march 3 2009. When i try to find the status of my application the operator says that the old passport no is not registered and i need to check with the mail room. I tried calling the mail room and there is no one to answer the call. Has someone faced a similar problem before ?
I used ext 122 to call the mail room , is there any other number that i can contact to find the status of my application ? Request the forum to provide some inputs .

If I can ask a few dumb questions:) (I might have overlooked this but these details, but this thread is huge now). When is the hearing? Who is conducting is? Is IV core involved?

It was not a hearing, just a meeting with some of the people I worked with over the past year on the stimulus issue.
Anyway, I went to the meeting and presented the issues raised by people here and emphasized that the first priority is recapture. Of course I raised the other issues as well, presenting the argument that America will lose its competitive edge if its highly skilled immigrants return to their home countries or other more welcoming countries like Canada, the UK, and Australia.
One person at the meeting was skeptical that many people have been waiting more than 10 years, saying that she has never come across anyone waiting more than 6 years and that these must be special cases where the people were doing something wrong. Anyway, I presented the stories people sent me, but when I raised the issue of granting a fast track to people waiting for more than 10 years, she said that there must be a good reason for it. They need to look at each person on a case by case basis and that a fast track would not be the proper way to resolve these issues. There was a lot of resistance from this person on several issues with the only wholehearted agreement on the issue of getting visas stamped in the US.
In short, I didn't get a sense that much would come of the meeting, but at least I had a chance to present the issues and I was given an assurance that they would be looked into further and discussed at some upcoming meetings. Finally, I said that the best way for them to understand the issues faced by immigrants is to be in contact with immigrants. I also suggested they join the IV discussions to get first hand accounts.

Now you are going to tell me, my higher education is due to IV, me coming to US is due to IV, me getting bachelors, masters, phd is due to IV, me getting H1 B visa approval and stamping, My getting EB 2 filed approved is caz of IV. , labor approval, 2 yr eads, medical appointments are all due to IV. You did exactly what you have accused others of(that is bashing). You could have simply opined, put your point through and left. But you went further than that, I don't understand what is the whole idea of one group passing judgment on others. There are EB2 better than EB3 threads, the labor substitutes vs. honest to God super qualified deserving PERM filers, then there is US educated vs. non US educated and now renters vs. home owner and savers vs. big spenders. What I fail to understand is, if you have to make your point please do so but keep your opinion about others to yourself on your blogs or you personal websites.

May be they are saving to for their future education or for their kids education ? For a small business ? or Simply retiring at 40 ? or May be having a bank account full of money gives them same pleasure that you get from your McMansion ? Or they simply want to live debt free and sleep well at night. So unless I have some material possession to show for my money, I am wasting it all away ? Isn't it ?

I work for a big 5 Software company & our lawyer Littler Global had taken a stand on July that they will not file our AOS application after the June VB was revoked/amended on July 2nd.
Surprisingly , today we have received a mail from them that that keeping in view our best interest they have decided to file our AOS case in July regardless of CIS receipting them.
Wanted to share this information as it may be helpful for you folks too ...
