Hi,
I have an California EB2 RIR LC app pending with backlog center with PD of March 2005. My 6 years of H1B are over and am an Indian citizen.
Is it a good idea to convert this application to PERM - my company lawyers say that there is a risk in that if the application is rejected, there is no back-up + it can take upto 8 months to process under PERM due to the conversion.

Dear All,
The idea about the oath is good. Most of us do great, creative things at work and earn the appreciation of our peers and seniors. Why not we brainstorm now, come with creative ideas to help ourselves?
Let us be open all new ideas. No idea is stupid!
Personally I would think of a mass satyaghraha but not sure now many will like it. It is a peaceful and well tried Gandian method to highlight our plight

Well I responded in Oct 2008 and it had RFE status. It didnt change for the past 2 years and it changed to "RFE Review" yesterday. Is this just a coincidence or something to extract out of it ?
For RFE rebuttal, it will remain in the same status until it is approved. You should have contacted them after 60 days of your rebuttal. But as of now, it is fine I guess.
My friend had very similar situation. His status remained as REVIEW until it was finally approved. So no need to worry.

Yes, that is what the trend look like. There is probably another 5-10% fall in the works. Perhaps even more. I agree with you on that.
However, the million dollar question is how do you know the prices have actually bottomed one? Won't you go ahead and buy if its affordable, instead of wasting precious years which shorten the career span and deferring your decision? Its almost like deciding when to have your first child...well..almost. There is never really a good time, is there?
By affordable, I mean its around 'x' times your (dual) income, you have your green card and you are prepared to live in the US for next 5 years at least (even if there is any family emergency, you don't have any compulsion to sell off your assets and move to India for good). Now, 'x' may mean different for different people but generally people seem to agree x = 3. And I also agree with you that it might happen that american housing is always affordable. Yes, it might but for most middle class in SFO Bay area, when x was 7-10, it wasn't affordable at all!
I completely oppose folks like Slumdog doing something terribly rash (no gc, no prospect of gc within a year, single income with a baby, baby having some health issues and to top it all the burden of a heavy mortgage on the shoulders, god, I think his situation is simply awful...) but the way I read it is that these indeterminate immigration waits are making people throw caution to the winds.
And I don't agree with folks who feel that buying your house is like renting it out simply because it is mortgaged. There is big difference, eventually its get all paid off and you start actually owning it. Secondly, for a lot of people that they can sell it during their retirement and use the sale proceeds to cover the retirement life. There is very good chance real estate would have appreciated over long term. Of course, you are just interested in 'flipping' you are asking for big trouble.
If you think renting is not 'quality of life' and you see it is affordable and prepared to lose money go ahead and buy. On the other hand, if you don't mind renting and don't feel like losing your hard earned money wait for the downturn to be over.

It depends on the service you choose, I think they have an option for expedited service and you can get the document within couple of days. They also provide you the pdf format of the document, you can print that document and submit immediately instead of waiting for the postal document.

Have u got any updates on ur application?They have mentioned "three weeks" as the standard time frame on the website....i guess yours has been there for three weeks.....have u heard anything from them?

INS needs money, best strategy stop all 485 for couple of months, let them back log, we will raise the fees exhorbitantly across board to 485/EAD/AP etc, then make everything current, ecpecially INDIA/CHINA that's where the money flow is from, but lets not make it obvious and dubious, we will move forward the dates for couple of years for June and make it current for July (remember July1 is the date new fees kick in), and then make sure everbody files and after 2 months, we will retrogress back to 3 or 4 years back to where we started so that conservative politicians are happy, that way we will have everbody in the INS Casino, no going out, keep renewing by paying more and more fees, INS haapy, I-485 applicants are in make belive happiness as spouces and children get EAD"

Last Update Date June 6 (for FP notice)

No updates since then.. showing "case received and pending". It's been exact 1 month since FP but there is no change to the last update date. It is still showing June 6th. Any idea what could be happening?

I bought my house in 2004 and here we are in 2009 - stayed 5 years . house went up to $430 ( from $330K) and then down to $300. Lost 10% so far . I made sure that mortgage+living expenses is within 1 salary (have dual income) . if I stay another 3-4 years i will break even at any price. Yes if i would have bought house in 2006 (peak) and got a job problem in 2008 yes- i would be in terrible situation.
Let's say if i would not bought the house - i would have used 10% down payment ( $33K) in some kind of investment (Stocks, bonds or CDs'). Based upon today's stock market i would have lost 30% on that until i would have withdrawn in 2008 Jan where market was at peak.
There is never really a good time, is there? . Now housing is almost bottom and interest rate is so low now - but job market is terrible and you need to be careful about your job. Now let's say job market get's better in 2010 and you plan buy a house in 2011. you think you will have everything in order in 2011 . Make no mistake, you will another set of worry and things to take care.
You need to take best decision based upon ur situation and need to minimize risk. You can only minimize the risk and not eliminate. A certain degree of risk is there in every step of life.

This is the precise reason I am staying away from IV, people just dont show any civility in the forum discussions and starts name calling or shot down the people who ask questions.
If IV comes up with just one single GOAL of reducing the curent EB backlog for the restorgressed categories, people even from RoW countries will start participating in IV campaign and support IV's advocacy efforts in terms of their donations and volunteering for IV.
