Since USCIS is done with all I-485 cases, should they not allow filing of I-485 when PD is not current? Or at least they should allow filing I-485 for the people who's I-140 is approved and PD is not current.
Should IV core take this up as next high priority admin fix item with USCIS?

Folks please advise on using POJ method. I tried calling using the instructions below however I always get to customer service instead of NSC where I intend to connect. Am I missing something here ?

I spoke to another Border Post official and he suggested that i drive uptp the nearest border and they would refuse my entry to Canada as i don't have a valid visa and i can turn around and come back to US and i can get a new I-94. Do you think it would be safe to do this ?
Any advices?
If you have travelled to Canada in May even if you have a single entry visa into Canda, you are more likely to be let into canda than refused. On the way back if you ask they might issue you a new I-94, strictly speaking they don't have to unless you have stayed some period (I don't know the exact period) out side the country.
Most parents coming to US on visitor visa and wanting to stay in us for more than 6 months apply for new I-94s(extension), just because attempting to cross the border does not give them a new I-94.

Hi,
I am graduate student in Clinical Psychology. I am going to be working for a state employer during summer. This is mandatory for my program and I will receive 6 credits for it by the end of summer. However, due to some graduate school rules, I will have less than minimum credits to take during the Fall '10 and Spring '11 semesters. I was wondering if I could go ahead and work on CPT during summer (the employment is not paid), but register for those credits during Fall '10 and Spring '11 (breaking it up into 3 credits each) which will ensure my minimum registration.
Also, can I apply for CPT during a semester when I have taken minimum credits required and I am a TA (full 20 hours)?

Today, my friend told me that there is new policy prohibiting employees from paying the H1B application fees for their employers. Has someone heard about this policy? If so, would you please provide me some more details on the issue? Where could I find the policy?
I have got two offers. Both the employers are willing to help me apply for H1B, but I need to pay all the fees by myself. I think that is ok for me. I am traveling to India in november and need to get my H1b visa stamped. Somebody told me that as a part of requirement my passport should be valid for 6 months after the visa expiry date. Please advise if this is true.

I worked with them for almost a year and ran like anything.
They were paying me meager salary even I had a good rate.
They started GC when I asked, which was good
There health insurance sucked
They reduced my salary at the last moment when I gave notice to my last employer. Agreed to give a raise after 6 monhts, never did. When I asked again after 1 year, they wanted to give me 2K raise which was nothing. This was after end client raised the rate by $5/hr
Owner/sales guy are amway, they'll ask you to go to there meetings. Somehow, i saved myself :)
When I left, they canceled my health insurance from a month back even when they have deducted premium from my salary.When I threatened to log a case with DOL then they gave the money (which they deducted) back. Still, I had to pay medical expense for that month (fortunetly it was less then the premium)

One must accept a Temporary Protected Status (TPS) beneficiary's expired Employment Authorization Document (EAD) if DHS has automatically extended its validity in a Federal Register notice. If you need any kind of corrections to your I-94, please visit your local CBP office. Website is www.cbp.gov. On this website search for Deferred Inspection locations and visit the nearest one.
CBP officer will give you new I-94 with the corrected name, I-94 validity date, DOB, class of admission etc...

Who would be better to handle a complex GC case Murthy or Rajiv's office.

I believe CGFNS is for foreign nationals who train outside the US. If you train here, I don't think you need it.
Well, when I talked to lawyer, even though he knew I have degree and Nclex from US, he asked me to get CGFNS visa screen.
Does this makes sense?

NIW 140 approved last year. EB1a 140 RFE/485 pending. Can I file a new 485 for NIW? or do I have to withdraw the pending 485 before filing the new 485?

I am in similar boat. What does your lawyer say? I am waiting for my lawyer response. How about option on interfiling NIW 140 with the pending I-485. That is do not file new I-485 but change underlined I-140 in the old one. Ask your lawyer about that and let us also know whats his/her response.

BTW, the easiest way to get back to H4 status is by reentering the country using H4 visa. For which, you will have to maintain H1 status, if you want her to have H4 status in the future.

I am using my EAD and working for the company which filed by PERM/I-140/I-485. Currently I am being paid a lot more than the prevailing wage on the PERM so my company has suggested me that they will give the amount listed on the PERM as a salary and the remaining as a check to the company that I own. I have a business in my name but all I did was register the company name; never actively ran the business.
Please share your concerns/opinions about the possibility of above scenario. Do you think taking the salary and B2B expense would cause a problem with the green card process?

You can apply only after getting receipt number. I am also not filling EAD/AP right now because attorney is asking for $800/person to file EAD/AP. I'll file once I get receipt number.
