The International Labor Organization (ILO) of the U.N. kicked off a four-day regional meeting in Stockholm Tuesday aimed at improving working conditions worldwide.
"Atlanta Labor Certification (ALC) and the situation in Cambodia remain the most pressing issues we are facing today," Swedish Labor Minister Nils Freivalds, the meeting's chairman, told participants. The participants are expected to endorse The “Missing Application Statue”, a memorial aims at educating the public worldwide about the Atlanta LC tragedy of August 07, when hundreds of thousands of applicants and their families were practically prohibited from applying to permanent residency and gaining labor portability. Those victims might have to wait for several years to get another chance. Atlanta shelved their LC applications for times ranging from 2 months to 2 years while the LC applicants at Chicago where getting results in 2-8 days.
“This statue is created to remind us of what has happened and what could occur if we forget the past. May the tens of thousands of applicants in Atlanta and their families always have a place in our hearts. And may their suffering not be in vain.” said Freivals.
This is the second time a UN agency interfere in an issue related to Atlanta Labor Certification. The first time was in May 2007 when the General Assembly voted to prevent the usage of the term “Atlanta Processing” referring to extremely slow and inefficient systems. The term was considered very cruel and inconsiderate toward the victims and their families.

Hi needed help regarding my starting date of my job. I am supposed to start my job in US on october 25th and currently i am in india. But I am still waiting for my H1B approval. If
h1b petition is approved and If I interview after October 25th(Start date) for my visa at us consulate back in Mumbai, Is it ok or will there be a problem regarding start date meaning will consulate officer ask why i am late or your start date is already gone how can i issue a visa........any adivce regarding the situation.

Hi:
Me and my husband left US on AP, which is valid until nxt year. We both were working on valid H1's until we left. We dont want to go for stamping and will use AP on our arrival at the POE. We havent applied for EAD when we left. Is it Ok for us to apply for EAD once we are back in US or is it ok to apply for H1's again once we r back. In both cases whether we go for h1 or EAD, can we start wroking rt a way or do we need approval first.

If you are planning to continue working for the same H1 employer when you return on AP, then you can start working immediately. If you intend to change employers, then either your new employer needs to file a H1 Change of Employer petition and you can start working once you get it approved OR you can apply EAD and start working when its approved.

This has passed House and I was reading in Oh's site that President will sign it soon. Is it possible to throw in some indirect 485 backlog reduction provisions in there?

I think most the news that H1B's are turned back @POE are not ture. My wife just got her second H1B stamped at kolkotta embassy ( end of jan) and we came back through JFK on Feb 14th. I am on my second H1B. Not a single question was asked. Again Not a single question was asked for first time. Before they used to ask the name of the employer or ur position. We both are permanent employees for a big company ( think of iPhone) and done our MS here. based on my recent experience I do not see any problem with you.

Kudos to Senator Chuck Schumer for raising the profile of a serious issue - discrimination against same-sex partners in US immigration law. Even as several states are enacting marriage equality laws and anti-discrimination laws are moving forward around the US (including here in my home town of Memphis), the antiquated Defense of Marriage Act prevents USCIS from treating these families fairly. The UAFA would be a huge step forward. The Senate will have its first hearing on the bill tomorrow. that's excellent news, but may not be very helpful for those whose priority dates are retrogressed, whether the I-140 is approved in 1 month, or 12 months.
Premium processing (i.e. PERM) helps labor applicants more because of the difference in processing times between regular and PERM processing.
For I-140 the average processing time is about 3 months only (source: http://www..com/usa-immigration-trackers/i140-graph/), so what's the big advantage of premium processing for I-140? Are they going to approve I-140 in one day with premium processing?
