May be some one who has already renewed their AP can answer this:

I am about to renew my AP. What will be the start date on the new AP. Is it the date after the current AP expires(like with EAD) or the date the renewal application is approved. Appreciate any responses.

    Can someone answer this please.

    Thank you.

Significant movement in EB2, possibly back to September Bullietin dates i.e. Aug 2006
The only reason why the dates may stay where there are for this month according to me is due to the elections in first week of Nov where some USCIS employees may be used for

As somebody said above, if we r getting married after Aug 17, and if we decide not to file my 485 now. My PD is May 2007 and my 140 would be approved before my H1B is expired for the second term, and if I didn't file my 485 by then, what kind of H1B extensions would I get ?? 1 year or 3 years.

To be simple : PD May 2007
    140 approved by May 2010
    H1B expires Nov 2010.
    485 not filed.

From Nov 2010, what kind of H1B extension I'd get (1 year or 3 years) ??

    Thanks

    Hi

While waiting for GC ( which may take several more yrs !!!) I want to go for Life Insurance, Since I am at age of about 40 its need to be done, though I have enough of that in India, not in US. In that regards I just started evaluating different options. Plesase share your comments and experiences during search of Life Insurance.

    (1) which is better to go for term life or whole life
Term Life is better , agents will push for whole life as the commission are more
You have to come to the term , till when you need life coverage, like your son graduating after 7 years or after 12 years you may not have financial liability towards kids etc

    (2) I started contacting agents (mainly desi) and they recommend Whole life ( if you can afford premium). They tell that it is ultimately result in Saving, Dividend etc. So my question is Does paying EXTRA PREMIUM ( i think it will be substantially high for whole life) RESULT in EQUIVALENT OF SAVINGS OR DIVIDENS? or just agents recommends that because they get more commissions with that?
Yes they get more commission on whole life , basically you dont need , if at all you think then you can go for term life which offers extension after the initial period with same premium

    (3) I see lot of DESI agents in New york Life, So is it due to their speciallity in Indian Community market? Does they offer competative products?
    No clue

    (4) How to search of best rate for Whole or Term Life, Does Select qoute and Other such agencies are good to their promise of getting low cost? Does companys that we get through Select qoute give Insurance to NON-PERMANENT RESIDENTS like US
    Check these websites
    http://www.insure.com/
    http://www.accuquote.com/

    (5) Which reliable comanies offer Life insurance to non-greencard holders (menas H-1B holders)
Some of the companies doesnt offer for Non GC ( not permanent resident) or offer with higher premium

    (6) please list websites that you thnik are good as per your experience while searching and evaluating different Life Insurance Options?
    http://money.cnn.com/magazines/moneymag/money101/lesson20/
Also have some information web site listed in 4

thanks for your insput which will help several members like me.

P.S subscribed monthly contibutions to IV and participating in its other faxing and email campaigns.

    Good Luck

although this doesn't fit 100% to your case. You may want to look at the attached administrative appeals office decision.

Essentially, a person was denied in eb2 because they had a 3 yr bsc and 2 year masters. they had education evaluationstating that masters indian degree was equal to us masters degree.

nebraska service center stated that 3+2 is not equal to masters degree. Admininstrative appeals office decision approved it saying that it didn't matter how long the combined study was. As long as foreign masters equals us masters then that is all which needs to be proven.

My experience has been that texas service center sends an rfe for this 3+2 education. I know of 8 cases where thie decision was shown in the rfe and they all 8 got approved. I know of one case in nebraska where this case was shown and they still denied it stating that it wasn't a precedent decision (person already had another 140 denied and there was some history in his case which i believe caused nebraska to deny it). Odd part was that the appeals office decision was from nebraska service center

The above mentioned case was later denied. AAO withdrew the approval. See this link -

^^ Please keep poll bumping for next few days ^^

A recent post asking about how many people have EB2-India PDs of 2003 or earlier had no responses, so I am curious about the potential spread of waiting people (atleast in the sample set of whoever responds to this poll).

RESPOND ONLY IF YOU ARE EB2 INDIA, HAVE FILED 485, AND ARE WAITING FOR APPROVAL.

(we can do separate polls for EB3-I, china, ROW etc)

Here is a post from Ron Gotcher's website which might be of interest to some of us trapped in EB3 I retrogression .
    http://www.immigration-information.com/forums/showthread.php?t=7065

He expects visa bulletin cut off for EB3 I to jump to 2004 in coming months. No reasoning behing this though..

Ron has not made prediction specifically about India. Somebody asked Ron about filing I-485 with May 2004 PD without mentioning that (s)he was from India. So Ron probably assumed RoW. The OP later clarified that (s)he is from India and Ron hasn't replied to that. So let's wait for Ron to reply before getting excited about it.

If Ron meant EB3-I, he's probably expecting a July 2007 kind of bump, which allows a lot of people to file but results in very few approvals. This can be inferred from his statement that, "your priority date will become current, briefly, in a few months".

We EB3-I's are looking for any sign, just any sign of hope. But let's be cautious in disseminating such information further.

will be glad to email, but so that all of us are consistent in our request, can you highlight what we are specifically asking for in lame duck session:
Is it SKIL bill, increase in visa numbers, or something else?
While we dont want to sound repetitive, it will help if we are all asking for the same two or three things.

do you think it will be helpful to have a generic draft of the email to send, which can be modified or not by each person sending it?

You can talk about how us competiveness is being affcteted.
quote February 2006 Economic Report of the President on IV homepage

basicall the first paragraph of IV site has info--
"Skilled workers are a small minority of U.S. legal immigrants. Of the 940,000 legal immigrants in 2004, only 16% were skilled employment-based immigrants. About 40% of these skilled immigrants had advanced degrees, or 5 or more years of experience after a baccalaureate degree. The impact of these workers’ contributions to American competitiveness belies their small number. They add to the process of scientific discovery, technology development, and innovation, which in turn leads to greater productivity growth. Greater productivity growth improves the standard of living for the U.S. population as a whole. Skilled immigrants not only contribute to the innovation process themselves, they also help train our own future innovators, thus ensuring the competitiveness of future generations"

You can talk abouty skil bill how it will help us innovation and also talk about retrogression and how 485 filing even if visa numbers are not available and recapture of unused green cards during the past years will help improve the quality of life for high skilled immigrants (engineers, doctors, professors, scientists, teachers etc). some information is here
http://immigrationvoice.org/index.php?option=com_content&task=view&id=71&Itemid=36 do not forget to mention IV name for more information.

nycgal369 if you could help draft a format on this thread and everyone could use it (with modification). Your help will be very valuable for everyone.

If I had my green card today, I would surely be making at least 15K more in my salary per annum repeat per annum.

If not all, many of you are in the similar situation.

My $200 contribution is just 1.33% of that lost opportunity per annum. If I take into consideration the 4 years of wait, it comes to 0.33%.

Almost anybody who is in US for 5 years on H1B can buy an nice little home. (Bay area is bit more cruel).

Last year I could have bought a home for say 500K. It would have surely appreciated by 50K. But because of the uncertainty of GC, I can not. That's a loss of opportunity of 50K.

My $200 contribution is just 0.4% of that another lost opportunity.

Now you know why I support this effort.

Most of you and your friends are in a situation similar as mine.
I urge you to become aware, make them aware and support this effort, which has a potential to minimize those lost financial opportunities, with your wallet.

    Thanks,

    nviren
    Great way to put it!
Hope you can post it at the other Forum where a lot of people do not seem to get it!

    To so called "freedom figher"

Court cases are filed with legal basis. Not on emotional outburst.

I suggest that you spend your $100 to get an advice from lawyer on your "points" including the meaning for "We the People".

    .

    Thanks for red, guys.

You are not even ready to take advice from an attorney for your "great" idea, and somehow believes that lawsuit is an easy game.

Have you have been to courthouse? Been a part of civil lawsuit? I have and I had guts to be pro-se (http://en.wikipedia.org/wiki/Per_pro).

    Have a good day!

"AMPLIFICATION: The above Washington Wire item on the letter from House Republicans to Speaker Pelosi urging passage of an immigration bill to "help and retain" high-skilled workers refers to legislation that would increase the number of H-1B visas and green cards for high-tech and other skilled workers. The question in the WSJ poll referred to a separate effort, pushed by President Bush, to revamp the immigration system and provide a path to citizenship for those in the U.S. illegally. The item wasn't intended to imply high-skilled workers are illegal immigrants"

They just updated with the above correction....

Here is the timeline for folks that are not serious

EB2 India: Waiting for July - October spillovers thinking that most EB2 will be current. The prediction threads have hyped this a lot. Many will benefit this year. But many will miss this bus too. Some from those who will miss this bus, would be back wanting to do something in Nov - May timeframe. Others will waste their time on predictions and trackers and make those site owners rich.

EB3 India: Many who filed in July 2007 are still happy with EAD status. They worry and contact IV only if their I140 is revoked, I485 denied or if EAD renewal is delayed. Some still sulk or want to blame someone (even IV) for their delays. Those who have not filed I485 yet are few in number. Many new Eb3s still do not know the extent of the backlogs. With time they will slowly learn about the backlogs and wait times. When they suffer due to lack of EAD, they will all make noise on IV asking for some action. This is the reason why the I485 filing action item thread is still weak and pre-mature. I would give another 2 years for the non-I485 folks to have retrogression sink in.

Retrogression is not going away. If it goes away, only applicants will benefit from it. And these applicants are too weak and small in number to even raise their voice. So why would anyone pass a law to make these people happy that do not even want any law changed. After 2 years all the folks who are not participating in advocacy days and contributing, will contribute to IV. At that time, if we in core are still around, would rather ask them to lead the effort if they can and if they are really serious. The current advocacy day campaign and contributions are a measure of seriousness for us to plan our next agenda items.

    Agree with Pappu.

We maybe happy now with EAD, but, we never know. Consider this, as per Yates memo

This memo is just a "interim guidance" and NOT a law. That does not make me very comfy. If it is a law, we can always appeal in court. Not sure about an "interim guidance "

It also clearly mentions, "this is an interm guidance and the final law can be more restrictive".

In the Yates memo, the 180 day rule is very Lenient , which many of us interpreted or will interpret in our favor.

While talking about rederawing of boundarie, there is another interesting proposal doing the rounds in the global political discourses. This one is not a prediction, but a proposal to redraw the boundaries of the middle east. The idea was initially proposed by someone called Ralph Peters in the Armed Forces Journal in an article titled "Blood Borders" .

The core idea behind the proposal is that the state boundaries of middle east are unnatural, and it has given rise to artificial, nonviable and oppressive states. The only way to permanently solve the problems of islamic terrorism is to redraw the boundaries of the entire region.

The idea has been floating around on the Internet for a couple of years now. No wonder, the nationalities set to benefit from this proposal (Baluchis, Pakhtuns, Kurds, Shia Arabs etc) are enthusiastically rooting for it, while the ruling elites of the so called artificial states like Pakistan and Sunni Iraqis are adamantly against it. Nevertheless, it is an interesting read.

I am posting the links to the original article, as well the some sites which displays the altered map of middle east. For more information, the curious can do a google search for "Blood borders" phrase.

Honestly though, OP's proposed law would get much more congressional support than EB reform.

If first you gave amnesty, and then allowed ppl to sponsor their parents on a GC, the illegal immigrant lobby would be very very happy.

Guys, why don't we open a page "Bets" ? There we can place bets if a bill will pass, if our ammendments will be included, if something at all will happen... This will make our life more interesting and we will be in a better mood. To wait for another 5-6 years for the GC :-)

If you want OCI, there are a few hoops to jump through -

    1. Apply for an Indian passport first.

    2. Once the Indian passport is issued, apply for the US passport.

    3. Return the Indian passport after the US passport is issued. The consulate should return the Indian passport back to you, but keep a photocopy in case they don't.

    4. Now you can apply for OCI on the grounds that your son once held an Indian passport.

Absolutely wrong. Lot of misinformation here. You can very well apply for OCI for your child even if both of you are Indian citizens and the 4 steps mentioned above are just wrong. I would prefer OCI over PIO as mentioned in the other reply too, on PIO your child will have to register with the police station evry six months if stay is longer. OCI is valid forever while PIO is valid for 10 (or 5) years and OCI means you have all the rights but can't fight elections and vote.
