Oh, I trust the attorneys to file it correctly, I was just wondering if there was any way of finding out if it was received and processed correctly. With the H1B, 140, 485, etc. you get a receipt notice, but I wasn't sure if that was the case with the G28, probably not.
The thought of the remote possibility of any correspondence from the USCIS going to the old attorney (for whatever reason), and not making it to me/new attorney in time to respond to it, is a little unnerving.

I agree. And this has happened. This happens NOT because new Attorney's G 28 did not get filed properly, it happens because VO may mix it up. Usually when a employer requests a revocation of 140 - in real - what the employer requests is "As this employee has left the company the prospects of his future employment with us is not there and we will not support this 140 petition in future. In other words an employer is telling INS "They will never hire you in future".
So the VO does two things here. They send acknowledgment letters to the employer and their Attorney on file and send RFE/NOID to you and your Attorney. In this process some mix up might happen. Remember, a lot of VOs are very ignorant about AC21 and they may not follow the guidelines properly. Under the AC21 law it is clear that all you do is to change job to a same/similar position. As long as you follow law nothing must happen.
Check your online status regularly - if you see LUDs call customer service - verify your address. If you do not get mail in 5 days - call again - if it is 15 days past call and ask them to fax it.

I think once the application is pre-adjudicated...that's it!! I don't believe USCIS will spend anymore time and resources to these applications again...until a visa number is available from DOS and they apply the number to the pre-adjudicated application....my 2 cents! I agree with what you say BUT they may open the file again (to verify certain things and not just assign it a visa) once the visa number is available (I guess that is what you are trying to say) ..is that right ?
BTW - I have not read the memo in detail ...it is a waste of time

AFAIK, AP is considered only for emergency travel. That said, I think the officer was being over reactive.
As we all know, immigration laws are arcane. AP for emergency travel was ok when people used to get GC within 6 months of 485 filing. Now, when it can take anywhere from 1 to 3 years to get GC after 485 filing, does it make sense to have AP for only emergency?! Crap...

Like I said earlier I pretty much feel the same way as you do. I want my spouse to be able to work for a couple of years before I think of moving back to India. But in reality having waited so many years do you think either you or myself will move back 2 years after getting the GC? Don't you think you will be tempted to wait 3 more years get the US citizenship and then move back? I have a few friends who are pretty much just waiting to get citizenship to move back. their argument is that we waited several years to get a GC and we don't want to just throw it away.
As for making H1B more humane I think it will never happen.
Most H1B holders get very good offers when they move back to their home countris after say 10 years. But the H4 spouse who spent al these years rotting in the USA again have to continue rotting....Their prospects are dim. So I want to get my GC. Let my spouse work here for couple of years and move back to my Own country.

So, others who volunteer their time, ideas ... are not CONTRIBUTING MEMBERS if they haven't paid 25 dollars in March ( since DONOR status started from March and 25 dollars is what is required to be a DONOR )
I am afraid, you are missing the point here - I did not intend to start a discussion on who counts as a "Donor". There have been several discussions on that topic and IV Core has laid out guidelines (if I am not mistaken, they have made attempts to go back and include folks who have contributed money in the past as well). Instead my focus is on how to increase "dollar contributions" towards our cause since as IV Core has clearly identified, nothing moves in Washington unless you have a strong lobby working for you, and as we all know, lobbying takes a significant amount of money. What I am interested in is simply - will you contribute dollars if, in exchange, you receive regular updates?
From a person who is in senior management position I'd expected better choices of words. Now on to your point of more regular updates -- let me ask you this - do you give weekly updates to your subordinates every week ? Do you share your strategy plans every week ? I believe whenever their is a material update to be shared, IV core will share it - predicting the frequency of it OR assuming that you will get an update every X days and see a progress is not a good practical idea.
Since you ask - the answer is YES. Not sure if you have heard of the "Servant Leadeship" but that is a management philosophy that believes an organization makes the most progress when the "leaders" at the top take the attitude of being "Servants" to those below them. The idea is based on the simple premise that people are more engaged and motivated to work when their boss listens to them and takes the trouble to keep them updated on what is going on. Instead, "Leaders" can always take the "high and mighty" road where they look down upon those below them (for various reasons - lack of trust being just one of them) but that is never going to be as effective or efficient as the former model I just mentioned. Don't take it from me though - feel free to do your own research on this topic and you will find that an increasing number of companies are starting to adopt this philosophy in order to achieve superior results and you don't have to look far to see how this is being practised in the world of politics today (President Obama).
Finally, IV has clearly positioned itself as a grassroots organization, but by articulating a philosophy of "we will share updates when we feel like it and think its appropriate for you to know about it", it is essentially operating in a somewhat "elitist" manner (though I believe, this is a purely a side-effect of it's loose structure, rather than intentional in any way). This also explains some of the questions coming up on the poll on "who constitutes the Core?" - while the website has a listing of the "Core" members, I believe some of that has morphed over time leading to the loose structure of today.
All I am really advocating is more transparency ...which should lead to more involvement as well. Thanks for your time.

Only folks with ND prior to current processing times can expect to have a chance at appoval...I see many people over here beyond the processing date window and are still hoping to get approved....
Let's see if this theory is right or not come september.....if only my lawyer had mentioned that ND over rides PD I'd have forced him to file on July 2nd and not wait till July end....

Does any of you know what rights for maternity leave has a pregnant H1B visa holder? I want to stay home next year for 3 months to take care of my baby, then start working again.
From what I know I can only have the 6 weeks of short term disability.
The Maternity Act does not apply in my case because the company I'm working for has under 50 employees.
I asked my lawyer if I can take any unpaid leave without loosing my H1B status and her answer was that I can change my visa to H4 or become a part time employee for a while. I do not like any of this options because I'm in my I140 stage with my green card and I do not want to lose it at this stage, after waiting for years to get my labor cert approval.
Your answer would be appreciated.

Let's say, I am not able to do that. But, do you suspect that they might APPROVE my 485 BEFORE my PD gets current? If they don't then, I am in no trouble, isn't that right? If they don't approve, then, I can add her into AOS when my PD gets current again assuming I don't file for EAD (I won't - I like my employer for now).

The fact that the law permits some things, does not have any bearing on the moral severity or the lack thereof, of those things. Would you choose a 'prostitute' over a 'shop lifter' for a wife? If these are the only 2 options, I would be content with a shop lifter. Would you choose a 'prostitute' because there are no criminal issues involved and you will get your greencard faster?

Lets learn from the chinese! dont you think they smell of fish and frogs, they cant speak proper english, they do not dress properly etc etc but they get their job done and are slow and steady. Part of the reason they are not easily insulted as we are is, they are very very humble people. They have learnt to respect others. Now look at we Indians. I am from South India. Do you think if I travel to the North I will be respected, let alone be considered a normal human being?? We tend to view everything that way. Go to any university and you will see a mumbai group, a chenai group, bihar group etc etc. First let us speak of how WE INDIANS treat other Indians. This is just like the Middle east right? When they have a common enemy they stand as one, otherwise they always fight among themselves. As somebody previously pointed out.
1) Respect yourself and others (americans). They are not used to your spicy smell, oil smell, untidiness etc. Instead of blaming them for not cooking, it would be better for us to take a few precautions: hand your dress/coats etc in a separate room with door and keep it always locked, preferably put a perfume paper or something on the floor in that room.
2) Learn to use chewing gum before group meetings.
3) Work to develop a cheerful attitude. Dont expect to be treated as a child is treated by a parent (always cared for type of thing). Smile and be happy.
4) Please dress decently and tell your friends to do so also. Many people dont know this basic requirement in the US.
5) Finally learn to smile at a fellow Indian, no matter which part of the country he/she is from.

After doing all this "very important" discussion about Rs/$ conversion, if you get sometime, please read some news about immigration bill to find out that there is lot of activity going on with the immigration bill. Most of the time anti-immigrats are calling and putting pressure on lawmakers who support any sort of immigration bill. That is why McCain, Brownback and many others backed out. Anti-immigrants are working overytime making it look like as if their opinion is the opinion of the entire nation. Each person is making 20-30 phone calls a week. But it is ok if none of us is doing anything. Lets all "time pass" and have this very important discussion about Rs/$ eachange rate variation... right?
Communities/groups/societies who do not understand the need to organize and standup for themselves always perish. Durbin-Grassley bill is just the beginning of the time for this high skilled immigrant community to disappear. After doing all this "very important" discussion about Rs/$ conversion, if you get sometime, please read some news about immigration bill to find out that there is lot of activity going on with the immigration bill. Most of the time anti-immigrats are calling and putting pressure on lawmakers who support any sort of immigration bill. That is why McCain, Brownback and many others backed out. Anti-immigrants are working overytime making it look like as if their opinion is the opinion of the entire nation. Each person is making 20-30 phone calls a week. But it is ok if none of us is doing anything. Lets all "time pass" and have this very important discussion about Rs/$ eachange rate variation... right?
Communities/groups/societies who do not understand the need to organize and standup for themselves always perish. Durbin-Grassley bill is just the beginning of the time for this high skilled immigrant community to disappear. Reason - When any group of people increases in number there is always another group which becomes its natural opponent/adversary. This community of over a million people also have very powerful opponent/adversary. That opponent is gaining strength and working overtime to purge all of us. But that is ok, let us talk about Rs/$ conversion rate. Anybody here from Uruguay or Morocco??? Why don’t people from Uruguay or Morocco and all other countries of the world join us in this VERY VERY important discussion about the recent exchange rate variation of Indian Rs/$.
