i have couple of questions.
1. currently i am on H1 and my wife started using EAD. First time i applied EAD and AP for both myself and my wife. Now, i don't want to renew my EAD but just renew my wife's EAD. Is this ok? What happens to my EAD after it expires. Will i be able to renew it in future or will i be able to apply for a fresh EAD based on my pending 485 with out a problem? what will be my status if i renew my wife's EAD alone with out renewing mine. will i still be on valid h1?
It is not a must to renew EAD; if you are not intended to use it in near future, provided you are maintaining you h1b. It won't effect you by extend your spouse EAD.

Same as 1, only if you intend to use AP for international travel. As you wife is using EAD she has to use AP for re entry as she lost non immigration status

Remember in life you have to have an attitude of respecting others, if u think you need to be treated specially cause you have lived in America 10yrs then u would be definitely disappointed. A lot of my friends have relocated to India and I am too early next year. The only answer is attitude.

We have members from all over the world. And as far as EB-3 is concerned the entire category retrogressed -- all countries. We feel that this is a problem that affects all highly skilled workers.
One thing to remember is that reporters take snippets from hours of interviews, and then their editors edit the article down further.

Lately i see a lot of new members coming up in the forum, with lots of questions about their problems that they are facing. And lots of good hearted IV members also give their diligent answers for them. One hand I am glad IV is getting new members, on the other hand i am wondering where were these members all these days.
Please don't get me wrong, As much as I like new members joining in the forum to get answers for their questions, I also would expect them to take part in any the activities or initiatives that IV is undertaking. Therefore I urge, every new member to volunteer in the IV activities and be an active member of IV and be a participating member, so that IV helps you and you help IV. Having said that, new members, WELCOME TO IV, post your questions and I am sure you will get good answers from many good hearts in IV.

I would say even Canadian system of education is different from US. However difference in Canada is 10% v/s difference with India is 80%.
Remember Canada is Commonwealth country and ex British Colony and their education system is amalagmation of British and US systems. So even in Canaz they will prounces Z as Zed and not as Zee as in US. They will also write cheque and not check.
Canada educational system standards are high. In Canada public school is free like US but it goes beyond US in that even school supplies are free. You pay nothing for pen, book, paper or anything used in the classroom.
Also in Canad there are public Catholic schools where school is run by Catholics but with government aid so you pay nothing. Something like private school with no fees. or your Indian convent schools which many of us may have been to.

‘(1) not later than 18 months after the date of the enactment of this section, an interim report on such results; and
‘(2) not later than September 30, 2012, a final report on such results.
‘(g) Application- An eligible school of nursing seeking a grant under this section shall submit an application to the Secretary at such time, in such manner, and containing such information and assurances as the Secretary may require.

‘(b) Use of Funds- Amounts collected under section 106(f) of the American Competitiveness in the Twenty-first Century Act of 2000, and deposited into the account established under subsection (a) shall be used by the Secretary of Health and Human Services to carry out section 832. Such amounts shall be available for obligation only to the extent, and in the amount, provided in advance in appropriations Acts. Such amounts are authorized to remain available until expended.’
(c) Global Health Care Cooperation-
(1) IN GENERAL- Title III of the Immigration and Nationality Act (8 U.S.C. 1401 et seq.) is amended by inserting after section 317 the following:
‘SEC. 317A. TEMPORARY ABSENCE OF ALIENS PROVIDING HEALTH CARE IN DEVELOPING COUNTRIES.
‘(a) In General- Notwithstanding any other provision of this Act, the Secretary of Homeland Security shall allow an eligible alien and the spouse or child of such alien to reside in a candidate country during the period that the eligible alien is working as a physician or other health care worker in a candidate country. During such period the eligible alien and such spouse or child shall be considered--
‘(1) to be physically present and residing in the United States for purposes of naturalization under section 316(a); and
‘(2) to meet the continuous residency requirements under section 316(b).
‘(b) Definitions- In this section:
‘(1) CANDIDATE COUNTRY- The term ‘candidate country’ means a country that the Secretary of State determines to be--
‘(A) eligible for assistance from the International Development Association, in which the per capita income of the country is equal to or less than the historical ceiling of the International Development Association for the applicable fiscal year, as defined by the International Bank for Reconstruction and Development;
‘(B) classified as a lower middle income country in the then most recent edition of the World Development Report for Reconstruction and Development published by the International Bank for Reconstruction and Development and having an income greater than the historical ceiling for International Development Association eligibility for the applicable fiscal year; or

My apologies for nitpicking on the DONOR definition and Congratulations on the new management philosophy you are going with. I hope you succeed in your endeavour.
Still I've some open issues. If you look at the poll, there isnt a single person who voted NO. We should expect to see a healthy mix of Yes,No and Dont Care. But the way the poll has been put and partly the wording, partly the current IV environment, people are sceptical of putting their real thoughts publicly. This excercise is futile if you have minimal 'NO's --- hope you are getting my point here. The only thing you might end up with is x number of YES and hope to translate the YES into more dollar value for IV and there will be some YES who are already contributing monetarily.
You are right in saying that we need to increase dollar contributions but tying it to frequent updates is not a practical thing. There are reasons IV Core cannot share their strategical plans with the masses and this is true in most places. By saying donate more and get more updates, we are setting us up for failures esp. if we expect 'real' updates. Even in an ideal situation, you will not have real changes every week and certainly not regularly.

I am into Datawarehousing and BI. Worked in multiple technology such as Oracle BI, Cognos, Informatica. It is frustrating to see my mid-size American Consulting Company charging the client a $180 per hour while I get $85K per annum. I cannot even switch to my client since I have signed a non-compete agreement..... I think direct marketing is the best way to augment your rates....
Well, I like you because you are just a straight shooter. If you are such a straight shooter then let me do some straight talk, so just catch this.
Your American mid-size company or Desi small size or super size company will get $180/hr but you will not get even $50/hr from the same client even when you go direct. So no matter how "highly-skilled" you think you are, your non-compete argument is not good enough for you not to be able directly market yourself, because there are gazillion other companies using BI, Cognos, BO, Informatica, Datastage and every similar crap. You can impress a few people by naming some technologies that maybe hot but they don't mean a &hit if you market them yourself. Here is why. A lot of people blame the lack of GC as a reason to be exploited. That is part of the problem. The other part of the problem is that most hiring managers in large companies get commission from these small, mid-size or large American, Desi or European consulting companies. That's why in most cases they always hire through one of these companies. They will not hire directly because the manager thinks you to be a stingy desi, and if he hires you directly the hiring manager will not see a dime, so why will he hire you directly? This is a big cycle of corruption and everybody is part of it including lawmakers who get contributions from lobbyist/representatives of these small, mid and large size companies. You think lawmakers don't know what is going on? You think client doesn't know that you make 85K when the middle company get $180/hr? You think the big-bosses at the company/client doesn't know that the hiring managers are getting favors from middle companies? You think lawmakers doesn't know that immigrant worker waiting for long delayed GC is bonded to an employer that buys employee retention insurance policy for the employer? They all know it. But you see every player in this movie, you, your hiring boss at the client site, the middle company, the lobbyist, the lawmaker and many more, they are all being paid from that $180/hr which you think that you are entitled for because you know Oracle BI and Congnos. Do you realize how easy this ETL, Informatica bull &hit is but somehow you seem to think that its worth $180/hr. And you seem to think that your problem is that other than you, everybody else around you is faking resumes. If you are so smart answer this, how will you avoid using two bitmap index on two columns in two tables when used in the same query? And why would you want to avoid using both the bitmap indexes? Na Na, now don't go to Asktom.com to look for an answer, you are highly skilled, you deserve $180/hr for knowing Congnos and Informatica, shouldn't you be knowing atleast this.
Sorry, did not mean to put you on the spot, just trying to highlight that the problem in this entire debate is, every player in the picture stands up for his/her position always trying to project self-righteous image highlighting the part of the movie in which he or she is the hero and all others are villains. And you seem to think that your problem is that other than you, everybody else around you is faking resumes. If you are so smart answer this, how will you avoid using two bitmap index on two columns in two tables when used in the same query? And why would you want to avoid using both the bitmap indexes? If u guys are staying in an apt make sure u have both urs and ur wifes names on the letter box, since the EAD comes with a return service requested seal on it, if ur wifes name does not show up on the letter box there are chances that it would be returned to USCIS. this happened to me.

The AC21 law was enacted to help you from exactly the same situation and you have absolutely nothing to worry about.
But as well know how USCIS works, the BAD case scenario would be that you'll get an RFE after your I-140 is revoked and at that time, you'll need to provide some proof of your employment in the same or similar field along with a copy of the AC21 text.
The WORST case scenario would be that you'll get a NOID from an ignorant officer, and in that case as well, you'll have to reply with same documents and you'll get approved.
Mark my words : Your I-485 will get approved ultimately(unless you have comitted some kind of fraud )
About the employer, I think he's right that any I-140 which has a pending I-485 associated with it , is counted towards the ability to pay and it affects the future I-140s from the same employer.

we can come up with many excuses that would easily fall under "emergent personal or bona fide business reasons" category.
I thought we must get ready with some reasons, when using AP to re-enter US. I have come up with some of my own that I may use:
1) Grandpa or Grandma is sick (most common reason, perhaps no body uses it as a reason anymore)(bona fide personal reason)
2) Land dispute (bona fide business reason)
3) Parents home need urgent repair (bona fide business reason)
4) Water shortage problem (bona fide business reason)
My Wife was had to go to India for a medical treatment. The cost of the treatment is much less then here in the US (also most of the health insurance dont cover it). She plans to go back in the next few months, Is that a valid reason?

:confused:I am in same situtation. I want to reenter on AP and continue on H1-B. Can I do that? My company says its their policy that once I use AP to enter I will have to switch from H1-B to EAD. I dont want to do that. Can I still continue on H1-B?

Good points, only thing to add is not all innovations can be brought to notice to relate to a single employee ...most of the times we as employees are part of systemic effort that is innovating. It would be wrong to say that H1-bs are not contributing towards innovation ........
