I am sure the jury will say that you are not guilty if your wife supports your side of the story. Remember, the verdict should be unanimous. So go for jury trial and request a court interpreter to make sure there is no language barrier.

Zen, the point is very simple. If you believe in this organization and what it does then you will donate knowing that IV needs the money to lobby for you, me and everyone else who is part of the community.
Lobbying is a very sensitive issue and it is not always possible for the persons involved to give you daily updates. Rather disclosing too much before time can have the opposite effect with people interested in lobbying against our interest mobilizing more aggressively.
Also bills are introduced all the time and there is not always enough time to hold funding drives to lobby for and against those bills. Moreover lobbying with the congress and senate is an on going effort and will require resources anyways.
However if you feel you want to be in the thick of things and know everything that is going on, then I guess joining your state chapter and being an active member can help you get some additional info. I believe volunteering your time is a lot more useful for the community than only money and if you can do that, all the power to you. I for one try and make my contributions to help those guys who are taking the pains to do all the work which benefits all of us.

SVN,
One irrelevant question: Why did you wait till Aug 15th, 2007 to file your 485 when your date was current in June and you could file in June 2007?
Just noticed your question - I was actually one of those stuck in the notorious BEC. As luck would have it, my Labor cert which had been stuck in local office processing first and finally made it to the second stage of labor was stuck there as well for months until it seemed like they finally were processing applications that had been received at the same time as mine. Then it happened - all labor processing centers were scrapped and everything was shipped in boxes to the blackhole called BEC. Little did I know then the upfront delay of months would be insignificant compared to the delay of almost 4 years at the BEC. In fact, my labor cert hadn't been processed by BEC even when the Jun 07 window opened up. As luck would have it though, in the month when everything was rolled back, my labor was finally cleared (thank god for small mercies!) and I was able to apply for both I-140 and I-485 when the window opened back up temporarily between July 30th and Aug 17th. Of course, I am still last in the line since USCIS processes based on application received data and not priority date! However, as I mentioned earlier, I am thankful to all of the efforts of IV that led to the window opening back up, which actually enabled me to file my I-485 and eventually receive an EAD (if not, would have still bee completely dependant on H-1, 11th year, now)

You mean extend DL when you have H1 Extension approval notice...?
I agree with you. PenDot does not give online extension for non-immigrants. Also they extend visa for H1 only after you get extension letter in hand. They do not accept receipt notice.

you will come acros these Jerks ..barely educated with BA music or Art degress or just some schooling and sitting as managers..what else can they do..abuse other people...prey on the weak..weak because we are on Visa...
they dont get any certification or any skills but however they want all the benefits/promotion..etc.
In such situation...dont let the situatuion grow..you need to change your gruop/company and remind the manager that they need to stick to rules..be diplomatic. If you are diplomatic and sensible in dealing with such cases..you will come out a winner..
Dont forget to complain to the HR about this person ...as this is a recurring pattern...then they will have a record of the persons behaviour

will be glad to email, but so that all of us are consistent in our request, can you highlight what we are specifically asking for in lame duck session:
Is it SKIL bill, increase in visa numbers, or something else?
While we dont want to sound repetitive, it will help if we are all asking for the same two or three things.
do you think it will be helpful to have a generic draft of the email to send, which can be modified or not by each person sending it?
You can talk about how us competiveness is being affcteted.
quote February 2006 Economic Report of the President on IV homepage
basicall the first paragraph of IV site has info--
"Skilled workers are a small minority of U.S. legal immigrants. Of the 940,000 legal immigrants in 2004, only 16% were skilled employment-based immigrants. About 40% of these skilled immigrants had advanced degrees, or 5 or more years of experience after a baccalaureate degree. The impact of these workers’ contributions to American competitiveness belies their small number. They add to the process of scientific discovery, technology development, and innovation, which in turn leads to greater productivity growth. Greater productivity growth improves the standard of living for the U.S. population as a whole. Skilled immigrants not only contribute to the innovation process themselves, they also help train our own future innovators, thus ensuring the competitiveness of future generations"
You can talk abouty skil bill how it will help us innovation and also talk about retrogression and how 485 filing even if visa numbers are not available and recapture of unused green cards during the past years will help improve the quality of life for high skilled immigrants (engineers, doctors, professors, scientists, teachers etc). some information is here
http://immigrationvoice.org/index.php?option=com_content&task=view&id=71&Itemid=36 do not forget to mention IV name for more information.
nycgal369 if you could help draft a format on this thread and everyone could use it (with modification). Your help will be very valuable for everyone.

Pappu,
Thanks for the response.
Not to offend anybody. but if you take a look at the sample of this thread as you can see the topic of discussion has moved from an action item to statistics estimate.
I admire IV and all its administrators, because grassroots efforts are never easy. IV along with its admins, has definitely had done a lot of hard work to reach to this stage.
At the same time, I would appreciate all senior members, and whoever reading this to keep the discussions more as a follow-up on action items.
Irrespective of statistics and the decision-makings of USCIS, it is very evident that some form of law changes must occur to clean-up this GC process.
As step 1 is bring an awareness among senators/congressmen and including the president that there is a problem that exists. I think this must be the only focus now to bring the problem in front with all the other problems that exist right now in front of the american politicians.
Again my 2 cents.

I have applied for FOIA during Oct 2007. No response yet. Just checked the status. Thank you very much for the link. I did not know it existed earlier. Do you happen to know how I can change the address because I have moved ? I called the number they listed for FOIA on reciept notice. The asked me to call the regular USCIS number to update the address. The person who answered the regular USCIS customer service had no Idea about reciept notices starting with NRC. Any solution for this?
All,
You can request a copy of I-140 approval from USCIS using G-639 form (download from www.uscis.gov).
In G-639 form, Fill out the following information
I) Type of request
-> Freedom of information Act (FOIA)
2) Requester Information
--> Your Communication address
3) Consent to release information
--> Please choose "A portion of my records" box
4) Information needed to search for record
--> Please specify only "ETA 9089" for PERM CASEs or ETA 750 PART A & B. ( I have asked for ETA 9089,)
--> You can also ask for I-140 approval copy(Since i have approval letter i didn't ask.)
*Note: If you specify portion of record in application, then it will be processed in Track one otherwise it is going to be in complex track(Track Two).
5) Data needed on subject of record,
--> Please give A#, Receipt number, DOB, I-94 Admission # and your name etc.,
6) Verification of subject identity
--> Notarized affidavity of identity
7) Signature of subject of record
8) Notary
-> Please Notarized the G-639 form
Send the filled form to the following address
National Records Center - FOIA Division
P.O Box 64801
Lees Summit, MO 64064-8010
You will get receipt notice with NRCxxxxxxxxxx which can be trackable through the following link.
http://www.uscis.gov/portal/site/uscis/menuitem.8d416137d08f80a2b1935610748191a0/?vgnextoid=f3a2ba87c7a29110VgnVCM1000004718190aRCR D&vgnextchannel=f3a2ba87c7a29110VgnVCM1000004718190a RCRD
I have applied it, it is in the process, i believe it is going to take minimum 3 to 5 months since my case is assigned to Track One. Every month they are processing atleast 1000 Applications. It may take morethan 6 months if the case is assigned in complex track. If you ask for full package then difinitely they will put into complex track(ie Track Two).
Please let me know if you need any more information on this regard.

Honestly , I was really inspired by the old IV core when we were the most active during 2007 ( we had a huge rally and all all that ) . U stll remember the follwing folks
Pappu ( he is the only one who still writes )
waldenpond ( Aman kapoor I believe )
needhelp ( Niloufer )
There was a guy from CA ( forgot his name and IV handle )
many many more ( not sure about their names or IV handle )
Where are these folks ? I do not remember to have seen a single post from these core members for the past 1 year at least . Could I requst the leadership to please come out and share your agenda and let us know whats the strategy and future agenda . We are now well used to to swallowing the worst news and if the news is bad and there is no hope for the next year or so lets be aware of that too .

vishwak,
I just got off the call from uscis regarding my I-485. My PD is in the first week of Mar 2006.
Per the USCIS website, they are suppose to process even the first week of Mar 2006 although the Aug VB says it is 01MAR06. I spoke to the second level IO and he was confident that my case would have to wait for the next month. I insisted that the uscis website says otherways, he went and verified with the third level (or his peer) and came back and told me that I was correct.
Infact told me that my case was pre-adjd and being reviewed by IO currently.
I am sure the same applies to you with the Sep VB. Good luck !!!
Note: This is not a legal advice and don't quote me on it.
Cool...This gives me some hope that my PD of May 8th will also be considered current from Sep 1.

There is nothing much that Obama can do unless there is bipartisan support in the congress. The House will not take it as Speaker Pelosi has said, if the Senate does not act first. In the Senate, Lindsey Graham is playing politics....... Unless, the legal immigrants and undocumented groups put pressure on a few republicans to get to co-sponsor the bill - it is a dead end.........

In addition to that we are currently in the process of creating local teams for every state. You can volunteer to create a team for the state of Illinois. Are you willing to do so?

LOA...means I am still employed without benefits ...at my old company.
what you said makes sense..this is how I am looking at it
-join new company
-donot send in ac 21 paperwork
-if i have rfe send in paperwork from present employer which will only be a generic letter----(i don't know how much detail uscis likes)
-the reason i want to do LOA is that this way i will be sure they will not revoke i -140
-what do the gurus feel ?
BTW--gave u green --thanks for the reply
In my opinion if you choose to use EAD, I think you will be very much fine with this route but with H1 transfer it will be tricky. You may have to go through 2 H1 transfer to come up clean legally. First H1 transfer to new employer and second H1 transfer to old employer again As you did not work for old employer for one yerar and hence no pay stubs and hence technically H1 dies there and so if old employer is willing "to hire again after one year" your old employer should file new h1 transfer and then you can come clean.
And during all this juggling make 2 things sure.
- You do not get promotion
- You do not get more than reasonable (10-20%) increment in the salary (The slary which was mentioned in your labor application)
Again before juggling consult the lawyer first.
