    I agree with your message that immigrants should clear their dues before they leave. I'm of the belief that, even if they complete 36 points in Social security when they leave, they should leave honorably without any dues/liabilities. That is the choice we made knowing the repercussions.

    Having said that, the way you pursued your argument in the context of non-GC holders having a home is not correct, in my opinion.


    I am completely opposed to non-GC holders buying a house. Tell me something - tomorrow I get out of status and can't find a job for 6 months and finally decide to leave, you think I am a fool to use up all my savings to disburse loans??? Its unthinkable. 6 months without a job is not far-fetched, I know several folks who were in the this situation. Without an employer my immigration status would be invalid. EAD/H1-B is not GC. Either you are a gc holder or you aren't.

    Buying house is optional, paying off the mortgage is NOT.
    I would buy if my family had dual incomes, we had our permanent resident status, long term plans to live in the US, income to house ratio was right (1:3 or something reasonable not 1:7 as it was/is with most middle class folks in the Bay area) and so on.

    Can you shed some more light on consular processing? I have 140 cleared and am already in AOS and possibly in NC. Is it possible to "jump fence" now or is it too late?

    Short answer is "NO".Assuming direct filing in consular Process, in general it takes less time (for most clear cases around 6 months to 9 months) with comparison to AOS. But that pattern was of old times. Consular processing also has to follow Visa Bulletin. Second factor also need to be considered is what ratio is for consular processing. If 10 % of total EB3 + 2 cases might have gone to consular processing then again those US visa offcies will also be overwhelmed. Seeing July-August load ,this time it is very hard to predict consular processing. But just sake for the argument if my prediction for future visa bulletin will become correct then MOST EB3 - 2003/4-consular processing filers will definately get their GC before December 2008. That surely can not be predicted for AOS seeing namecheck etc.

    Note: After some time (2008 end) you will also see fence jumpers (AOS to
    consular)as people will hear fast "initial" approvals from consular
    processing.

    My I140 is approved and now I am filing the I 485/765/131 together based on new developments. Now that all dates are current, are they going to process the application based on July filing date or based on Priority date(labor).

    Can please someone confirm that. My attorney says its based on priority date but I just called USCIS information desk and they said that its based on 485 application date.

    i don't get it you are saying that members don't have to search...and yet someone has to keep it up on the home page...which is it? yes a sticky thread would have saved work and not required someone to keep it up. Why wasn't it done in the first place. When a service is supposed to be offered every week...it should be offered every week...or else there should be an announcement that is will not be offered this particular week and that it will continue next on said week.

    No reason to be frustrated when people are asking simple questions...another idea would be to put the answers to the most frequently asked questions on the FAQ page...which does not work right now....so that you don't have to repeat the answers.
    Its an easy solution i think.

    Giving a long lecture of frustration is not the best way to attract people to an organisation.
    Think about it...do u go buy clothes from a store that voices their frustrations about the prices of raw material...of do u go buy it because they were nice to you...had great customer service...nice selection of goods...and fair prices.

    I am sorry but working for hours on end alone, voicing frustration at lack of participation, treating members like they are morons for not being able to find supposedly simple things is a really terrible way to attract more people to an organisation. The cause may be noble...but who will wanna join some organisation where people just complain about how miserable things are.

    Please pause for a moment and think about what i am saying. This is exactly why you have less participation and less donation. IV needs to transform into a vibrant fun place to be while still upholding the noble cause.

    Why dont you do customer service for IV as a volunteer if you think IV is not responding right? How about that? I myself have some complaints but I agree with IV is doing for us. But since I do not volunteer, do not have time to do anything for IV or even donate, so I have no right to just complain. But I have seen people volunteer and help out for me and you. They talk to Senators for me and you and this is a big work. It does not matter to me if the thread is bumped up or is a sticky. Making a thread sticky will not advocate for me for my green card. So it is not important for me.

    Teddy. The intention of such post is to tell people that they need to look beyond spending time on predictions. Predictions can help people know the extent of the backlog. For some it is a motivating factor because they were in the dark until USCIS started publishing data. People used to think their Greencard is round the corner and had no idea about the backlog. So yes the data and estimations have helped get a clearer picture. And this has benefited our community. IV has worked for several months to get the data from USCIS through its agenda item in the past. Today USCIS is publishing data at regular intervals because IV community had participated in a mass campaign to get FOIA data from USCIS. There is a whole history of advocacy behind the data everyone is using for prediction today and it was advocacy that got things done. However they should not get stuck with it and have a more 360 degree view of the issue. For some predictions are a source of encouragement for advocacy work. People leading predictions can play an important role in giving direction to others and help solve the root cause of the problem.They should be urged use it for the advocacy work as well if possible. For example a good research document can be made to illustrate visually the extent of backlogs and wait times. This document can be then circulated to media and lawmaker offices. Do not look at predictions in isolation. Secondly, the data people are using is still incomplete and has lot of assumptions. I had posted some update on the data in the donor forum early this month based on a recent meeting. So predictions we see on the forums will not be fully correct. People need to use predictions as means rather than consider it as an end.

    That is exactly why these are known as PREDICTIONS.

    2) Reinstate premium processing for I-140 (very urgent)
    2) Preventing wastage and recapture of visa numbers (atleast atempt)
    3) I cannot buy a house because of uncertainity

    I have the birth certificate from my 10th grade. The one we got after the 10th grade board exams. Is that ok. I don't have any other cz I was born at home :o
    Will that work?

    I don't think your 10th grade certificate will work. The birth certificate should be given by the Muncipality and it should indicate the date your birth was registered, your name, DOB, Father and mother name.

    If you don't have this kind of certificate, you need to submit a non availability certificate with two affidavits.

    I thought IV core is supposed to come out with action items (or lead - all they need to do is come out with an action thread and people will follow).
    if people were to follow all calls from ordinary members then 2 things would have happened ..one IV would have been more dynamic (Since everyone is calling for action items) and people would be running in all directions.
    this is probably my last post ..what is frustrating is that whenever anyone asks genuine questions ..people just jump and attack.
    as for lobbying ...the maths is simple ..if IV is collecting around 10k (or less) every month ..then it will take 5 plus years to collect the money for any sensible lobbying ...

    You are talking as if you follow IV core to their word. People like you criticize IV but never do any useful contribution. You didn't even fill your profile. You haven't contributed even for FOIA and now saying the IV is collecting very less money. Are you insane??

    Thank you, Amitjoey, Pappu, Anurakt and all those who helped keep this campaign alive. I salute your positive, 'never say die' attitude. I am re-joining this and all other IV campaigns actively, now that I am back from a trip to India. I am confident that together we can provide that final much needed push.

    There is something called fraud protection fee that companies pay for initial H1's. So USCIS has the funds to protect the fraud, the question lies if they are really implementing it.

    The GOVT should state that those who apply for H1 should make it mandatory for the employees to be in US within 30 - 45 days of obtaining US Visas and be present in US on employment in continous increments of 1 year. And they need to show pay stubs continously.

    - Then we can easily filter out WIPRO, Infosys, Consulting company from misusing. For example Wipro will apply 5000 H1s and then send people when they eventually get a project, out of 5000, may be 1000 may show up in 6 months. So In this case 4000 H1s can get invalid. Indian companies find it sending people overseas is expensive business and would enjoy offshoring projects. If the govt makes this rule, consulting companues will be forced to start paying H1 folks from Day 1, no bench period, plus "Candidates need to show up in person immdlty in US". We kill 2 birds with 1 stone. 1, dummy H1s will not be applied, 2, if they approve H1s then they have to send engineers immdlty for which they may not be really ready, since they only anticipate projects and may not need so many H1s right away !...

    THis will be a sure shot solution.

    Not sure how this two application thing work, but doesn't this kind of situation trigger unncessary confusion with finger printing etc.?

    As far as I know, when USCIS collect the Finger Prints everything will be in the same database and the name check, back ground check etc. starts from there. If you apply two applications then you will get notifications twice? Unnecessary risks and confusions, if I were you..I wouldn't do this.

    USCIS is so unpredictable, what if they do back ground check twice and create some weird confusion or one of you get stuck unnecessarily? This is a very confusing scenario. Talk to your attorney.

    At this point it may be better to understand how much do you need in next three months. Getting a committment for $20 contribution in April or June is of no use if we can't meet, let's say, 20% of our need in Jan.

    I just can not believe that the above is not registering with most members.

    On a related note, free riders may not be checking this forum. The title says that this is of no interest to them.
