This per-country level is established by the U.S. State Department to act as a "barrier against monopolization" and to provide fair opportunities for all skilled and professional workers from around the world. H.R. 5921 would remove per-country limits and would no longer allow unused family- or employment-based visas to be used interchangeably.
Please know that both H.R. 5882 and H.R. 5921 are under review by the House Committee on the Judiciary. However, no companion bills have been introduced in the United States Senate. I think it is important to recognize that our immigration policies must make national security a central priority while at the same time helping to facilitate family reunification and labor demands here in the United States. I will continue to pressure Department of Homeland Security Secretary Michael Chertoff to ensure that any policy to expedite visas does not compromise our standards for accepting individuals into the United States, nor the integrity of our immigration system. Absolutely true, It is torturing the kids for the aspirations of the parents to be seen in the national TV and for award.
It is not the poor kids are not getting the award, it is the parent, especially it is the trend with indians.
why ? ask your kids to do same and see what you feel on that night. can your kids do same ? forget about torturing or anything for a moment. Didn't you see Nupur Lala a past winner where she is now ? if she was torture for that competition she would n't be in MIT. its a competition of brain power to me.

Do you know if one is better than the others...like murthy is better than rajeev khanna .....Basically who has more experience and success handling AC21 and MTR cases...I spoke to one of the murthy attorneys and they seemed to be good... but again I donot have any personal experience... No idea. It is difficult to judge them. All Attorneys are out there to get money and there is only so much to Immigration law.
Immigration Law is not all about courts and cases and judges, immigration lawyers are just like "consulting agents" - all they do is proper paperwork and are certified to provide immigration services.

Unfortunately, I can't leave the US for the following reasons
a) AOS pending
b) H1 expiring soon
c) Won't get any vacation time as just joined a new job.
If you have applied for AOS in July 07, you probably would have got your EAD by now. Why dont you use your EAD to get a DL renewed?

They hushed up and approved my EAD in 20 days. Why ???? 'cos So they don't hit Jun'30 and give 2 years. They wanted to milk another 680 from me so they hushed up and sent me the 1 year EAD in 20 days.
I guess we all have problems with USCIS, either with their inefficiency (eg. receipt delays during July Fiasco), or sometime with their super efficiency (EAD's getting approved too fast):D

This rule of having at least one parent Indian citizen is in existence since atleast 2006. Just search around. I also know this as one of my close friend's OCI application was his kid was rejected based on this rule more than a couple of years ago !
You are correct. The rules must have changed recently. I wonder what made them make that change, Now children of US citizens (who were once Indian citizens) have an advantage over children who has both parents as Indian citizens. Weird.. isn't it?

actually more meaningful campaigns spearheaded by core will make people donate more.
right now some members are saying that the donations being made is for lobbying.
how much does that cost ? how much is needed ..more information is needed.
say if lobbying costs half million and every month we are able to raise 10K ..then it will take 5 - 7 years just to raise that amount
any new campaigns like removal of country limits, campaign for recapture, campaign to make EAD similar to temporary GC will make members donate more and attract new members !! Period.

What about the false promises and carrots and propaganda of liberty, equal opportunity and land of opportunities? Of course they wont say its land of indentured servitude. Its our fault that we didn't figure this out, isn't it?

All the rhetoric about going back to India (yes I have seen random cases, heard anecdotal cases) is nothing but empty threats. I do not see mass exodus and highly doubt if it will happen in the near future.
Waiting for GC and then citizenship being hell kind of statements is doing more of a disservice than any real effort to help our cause. Growing up and acting like mature professionals with a proper plan like many active members who are working so hard is so much better than to open childish threads (the last para is not directed at you).

I dont think this bills has anything favourable to legal immigrants... It better to apply as the other category ....
I think someone finally saw the light here.
Cant you guys see the HUGE change that this is. Get out of the whole legal-illegal pissing match. This change will make the US immigration system in line with that of the UK. You get here. You stay here for 5 years. You apply and be granted Permanent Residency. Thats it.
Will that open the floodgates? Sure they will. How will they be countered? By making it very very difficult for employers to hire foreigners. If you are already here, you are fine.
Employers who hire illegal folks will face tough sanctions. the new eVerify system will probably now be mandatory for all. That takes care of those employers who were in the Dont ask, Dont tell (not talking about the military policy towards gays here) attitude. It wont weed out everyone and there will still be some guys who will work for cash, etc but it will reduce this significantly.
Employers who abuse the H1 system will now have to do lots more to prove that they couldnt find a qualified US worker. The desi employers that everyone loves to hate will find it very hard to stay in business anymore.
The big IT companies like TCS and Patni who pay 40-50K to someone with 7 yrs of work exp (like I was) will now be forced to hire from the US market thus eliminating the chances of abuse. Unfortunately it will depress IT wages in India because these biggies will need to show some kind of cost savings to do work offshore otherwise most companies will decide to bring the work back since its just not worth it to handle the hassles of offshore work. But overall it will bring some kind of balance.
All a person now will need to do is get here and manage to hold on to some job for 5 years and you will be through.
Lets see how much of this bill actually makes it out. As far as I can see, I am prefectly fine with refiling my application under this new category. The hell with EB based green cards. USCIS can take the whole EB1-EB2-EB3 and stick it where it belongs.

Last year when I converted my out of state DL to a NYS DL, the DMV gave me a 5 year valid license (expiring on my DOB on 5th year i.e. in 2011) but on the fornt of the DL mentioned in BOLD RED the epriery of my I-797 date as 'TEMP VISITOR EXP.'.
So guess I am good till 2011 ...

These IV core people took it up and organized a real grassroot effort when no other h1b or former h1bs were able to or willing to get organized and fight together to alleviate our pain.
The other day, reading posts/comments on WashingtonPosts by some former h1b holder against our cause really aggravated me.
If you don't agree with IV approach, that's fine and just add your dissenting voice into this organization, and continue and add to a healthy discussion. Now that this legislation pass or fail is so imminent, can't we just focus on one thing at a time? Being a detractor is not of much help with the senate and hostile house considering major reform bill(s) within the month. Let's say AILA would be of great help and sorry IV failed to realize how important they were, it's all too late now, so let's focus on doing whatever at hand the IV has already organized and built a momentum for.
Whatever the outcome, I'm happy some people organized this all. We'll fight on..

Yes, GC is not life, we might back to our country still with good quality life. But deported by this piss-off reason, We really can't be ease.
Just meet some prideful but stupid local American, can't depend on their intelligence. Just like my wife tried to explain we don't speak English at home to refute that ridiculous "help" shouting, but the leasing office ass manager question, "Why you speak English with me now??? " How can I comment? "Can you understand if I said my native language?" Finally we have to find a new apartment in 3 days.

I think you need a second opinion from a lawyer, no one here can really help you (unless he/she is a lawyer).
If your version of the story is really the absolute truth (assuming there is no wrong doing on your part) then you should fight, the system is fair (I'm sure people understand language barriers) and I'm sure judgment will be in your favor.
Just a word of caution... Don't underestimate the intelligence of people making the judgment, they deal with such cases everyday - they can easily smell a rat.
GC is not life, the trial verdict can change your life for better or for worse (specially if there is jail time involved).
