Well - from what I understand is that - these are the low hanging fruits - just like how you optimize time and resources, they pick candidates that are approvable and and utilize the time to process.
It is actually meaningless unless they make it public - say - send a letter saying that your case is preadjudicated and all we are doing here is waiting for the number.
If it is something internal - then well as long as your file is lying on the shelf waiting for visa availability internal policies may change anytime.

What are the chances of this bill getting passed? 10% or less? When is this bill going to be voted on? one good thing is Sen Kennedy is one of the co-sponsors and he's got some pull in the congress.

I understand that you guys have done a lot with limited resources, but trying to isolate yourself from the issue of illegal immigrants issue is not going to help us either. We need to use the momentum of illegal issue to sneak in our provisions (which we already have with the advance degree provision, exception of spouses from cap,capture of unused visa numbers).
I think you are wrong in stating that I do not grasp the issue that AILA is only interested in illegal immigration issue and not in EB3 retrogression. I know that more than you can imagine, which is why I have been urging the forum to stop asking every one to fax the senators with requests to remove hard limits by country or even concurrent filing of I145 when visa numbers are not current. I read on post by a junior member where that person DID GET A CALL BACK FROM ONE OF THE SENETORS OFFICE AND THAT GUY COULD NOT ARTICULATE THE ISSUE WHEN THE SENETOR ASKED HIM IF THE ISSUE WE ABOUT INCREASING H1-B�S.
Exactly what happens when thousands of people contact senators instead of one fax from one organization with one point of contact just so that if some one actually calls back from the senator�s office we at least have some one who could explain the situation in a way that makes sense?
Also, I know how difficult it could be to get an amendment in just as well as you and I also know the fact that the real interest is in solving the illegal immigrant�s issue. The reason for that is the issue that the U.S has is with ILLIGAL IMMIGRATION. The EB retrogression is really our problem, not some thing that is going to raise alarms in the senate. Which is why any amount of hue and cry is not going to change the situation? We should be glad that the advance degree provision, recapture of unused visa numbers and exemption of spouses from cap will make way for a few people and in the process clear up the backlog in EB3 category. Great job guys! Keep up the good work. The article has given much needed exposure to the problems of Employment Based Green Card Process and the plight of skilled workers from India and China. AC21 can be as safe as a any normal 485 case so do not worry. Its classic case of USCIS ignorance on AC21. I would say, hire a good lawyer and prepare for a MTR. I have seen Ron Gotcher as a very prominent proponent of AC21 rules. You can take his help. I used AC21 and got GC approved without any hiccups. My case was handled by Ron and I have been completely satisfied with his services.

Yes, flight to DC would have been then recovered from USCIS in the lawsuit against them.. :)
We have a few people making their way to USCIS - so we should know in sometime.
Actually when I say a few, there are probably only 3 or 4. Even after working the phones, emails and private messages, we could not get too many DC area members to help out.
If I have one regret for this campaign it is that I should have booked my flight tickets to DC - it would have been just so exciting to have such a good opportunity to voice our issues and concerns.

I liked permfilings idea about a mass day off from work...and a small meetup in each town..however this has to be publicised that its going to happen...I guess this should be the first symbolic thing..the next thing..i really loved the sweeping streets idea...we shud do this in front of capitol hill...much better if we all wear suits and carry brooms to brush the dirt off..and have posters that say..PLEASE BRUSH THE DUST OFF - OF MY GREENCARD APPLICATION AND PROCESS IT....

Also, please realize that any changes to the bill will meet absolute resistance from both sides. We will have to wait and see how many amendments are they planning on allowing.....
Ragz to be perfectly honest i know this bill is VERRRRY important to us, but this bill carries Far more problems than relief. Right now there are So many "Ifs" and "Ands" that somehow i dont see it passing or atleast not anytime soon, forget abt passing by memorial day.
If it actually DOES pass by memorial day, that day actually WILL be Memorial for us legal immigrants :) But one another note. Thanks for posting the link. I know a lot of us are writing the same thing, but that should not deter people from posting info like this on the forum.

I am on H4 Visa. Recently i got charged with misdeamener for comming out of store with out paying bill for one of the product. Not arrested and no finger prints taken...just given a slip to attend the court. My attorney advised to attend first time offender program, where after some community service, my case would be dismissed and i need to file for an expungement for trashing all criminal records. Now my question is i have my H4 extension that needs to filed in jan 2012. If my expungement process don't complete before my husband file for h4 extension, will USCIS deport me for having criminal record ?
If there is a possibility for deportation, then i will be leaving to my country then get deported. So that my husband will only file h1B extension and later we both will move to canada at some point as we have PR in canada.
Any advise, will be highly appreciated.

Hey Payton.,
Once you receive your DS230 form from the NVC you can find the NVC case number on the bar codded sheet. After you submit your DS230 to NVC using that NVC case number you can dial a number and check the status. Mine after 4 weeks says that NVC has completed the processing and forwarded to the Madras consulate on June 5th. Thats how I came to know.
By the way mine is EB2

Think of it this way. Conservative estimations say that in the recent application rush, USCIS received 300K applications.
That is 2 year's worth of applications alone, not including those already at USCIS.
If you compound that with the asinine 7% country limit, and assume that there are MUCH more than 7% of that 300K from Indian nationality - I'd say you are looking at much longer than a 3 year wait on average. I'd guestimate 7 years.
The only way this will change is to support the DC rally. We are getting major traction and positive news on this and it's potential affects. Please do everything you can to come.
There are people offering to pay 100% of airfare, there are free buses being set up. There are very few valid reasons not to come!
